Failure to file AOS creates a couple problems:

1.  Your wife would lose any legal status, thus becoming deportable.  In the past, that might have been safe...not so much now...

2.  If you decided to file AOS later...like years.......it would definitely draw a lot of attention and scrutiny.

Imo, it isn't an option unless extreme circumstances arose....of course, if you married her, and she entered the US via a CR-1, no AOS is needed....in fact, the CR-1 is superior to the K-1 in every way imo.....other than the separation time being about 1 to 2 months longer for the CR-1.

Yessss. I like the cr1.. Either cr1 or k1 the income i need is the same but with cr1 we get to marry with her family there and she will receive the green card with the visa... I was just bouncing around to see if my sponcer could help.. But my sponcers set income is about $500 short of the required income... So thats off the table

With a CR1 you can use a joint sponsor and you will combine the two affidavits to get over the thresholds

YMMV

Yeah i failed the math on the GED twice as i left school in 10th grade... I will be taking classes when im able too but for now i need to focus on making the $20+ for the whole k1. I live with my parents rigjt now with no bills at all.. I plan to get my own place by year end. Once i get her here then im going to go back to school.

No offense intended, but your plan is wrong.

You need to get your education sorted out to get a chance to increase your income first.  From your writings here, you sound very immature, disorganized and impulsive. Not a good mix to have a successful marriage and immigration journey.

You might also be very loving, and that is great, but not sufficient.

Best of luck to you.

Im asking if the income tax return money counts as income...

I gotta use all i can get... On paper im supposed to make 20k a year but it will end up in tje 14-16 range so yes i will get a second part time job. But im just curious if the tax return money counts. 😁

USCIS wants to know about your current income. A tax return refund may have been due at the time you filed, but is no longer being received and is not ongoing so it won't qualify.

For instance, somebody who signs a contract for $50k in work over the first 6 months and then completes that contract is currently earning $0 from that source. A graduate student earning money on a stipend typically gets a one-time payment as well, which would also not be income in terms of how USCIS interprets current income.

This is only true for certain family household members who are eligible for an I-864A (a contract between a sponsor and the household member). Separate sponsors cannot combine income.

For instance, the father could be a joint sponsor and the mother could use an I-864A to join her income with the father (assuming they are still married and living together).

I see that you noticed this original statement was incorrect already, but I wanted to provide the background information of when incomes can be combined. :)

I believe the user @pushbrk has posted before about a situation similar to this.  Hopefully he sees this and comments.

IF the son (petitioner) lives with mom and dad then they can combine income using 864 from son and 864a from dad and 864a from mom (if mom had income as well but it seems she doesnt)

"This obligation can only be undertaken by an actual relative of the petitioner (spouse, adult child, parent, or sibling), who is living in the same principal residence."  I dont believe the parents HAVE to claim him on their tax return to be considered household members. I will defer to pushbrk on that.
