I have personally never known anyone denied, So I don't know that answer.  And I have never read of anyone getting denied and going home.  I would think if someone was going to file AOS they would wait until they could show enough income or sponsorship (if that is an option on I+864) before filing, it would be silly to file if you didn't reach minimum.

 

I have done the AOS two different times, One times I used my assets, last time just last year I used my Income Tax since I am self employed and I don't get a paycheck.

Get there, get adjusted and live there and find work there and establish some type of business there.

Seripusly thought about it.... Really have wouldnt mind getting a nice bike and riding everyday there..

 

But technically i make the 20k a year at $10 per hour 40 hours a week i just need another job to make sure im above that cuz after sick days n holidays early days at tje end it wont be 20k

What part of Philippines have you been going to? 

 

Here is what I did, I got tired of waiting on public transportation like Jeepney, Tricycles, or buses.  I went to a Honda Dealership which is all over the country, I picked up brand new Honda Motorbike for $1,600 US dollars cash out the door.  I go all over the place on it, never again do I wait for public transportation,  Best investment for me to date in Philippines, and it sips the gas.

Davao city yeah ifffffff i did move there thats my plan to get a Ktm duke 200.

 But thats last resort. I think its silly i cant make the funds i just need 2 jovs.... Tax returns count as income aswell??

Davao City is my home base.  They require you wear helmet there to ride in city, and back when Duterte was mayor he put many restriction on speed limits there, plus you have to wait 30 days after buying motorbike there before they give you paperwork to release it to you.  

 

Just take a trip to Digos City about 40 minutes south of Davao City airport, and you can buy it and ride it off the lot there, plus they don't enforce helmet law there as well.

Yeah but we dont want to live there really. I just need to come up with the funds.. Income tax returns count as income aswell?

An income tax return is a way to report your income, not income itself

Failure to file AOS creates a couple problems:

1.  Your wife would lose any legal status, thus becoming deportable.  In the past, that might have been safe...not so much now...

2.  If you decided to file AOS later...like years.......it would definitely draw a lot of attention and scrutiny.

 

Imo, it isn't an option unless extreme circumstances arose....of course, if you married her, and she entered the US via a CR-1, no AOS is needed....in fact, the CR-1 is superior to the K-1 in every way imo.....other than the separation time being about 1 to 2 months longer for the CR-1.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

In addition to my tax returns,  I had to submit a letter from the Defense Dept stating that my military pension would be a lifetime income source.......and I had to submit a letter from Social Security stating that I receive retirement benfits....both are proof of current and future income.

Do not bring your fiancée before you have the savings set aside to do the AOS. You are not making a living wage now, you would not be able to support her, so you will need her to be able to work as soon as possible.

 

Before any thoughts of visa, you need to try to get your degree and better income.  People get their GED in a few months.

Im asking if the income tax return money counts as income... 

I gotta use all i can get... On paper im supposed to make 20k a year but it will end up in tje 14-16 range so yes i will get a second part time job. But im just curious if the tax return money counts. 😁

Yeah i failed the math on the GED twice as i left school in 10th grade... I will be taking classes when im able too but for now i need to focus on making the $20+ for the whole k1. I live with my parents rigjt now with no bills at all.. I plan to get my own place by year end. Once i get her here then im going to go back to school.

The requirement is current income.  Your income tax return shows a historical of your income.  You use your tax return to show history
