Ive desided im gonna go back this year i need to see her... Onlyy problem is ill miss a few weeks of work.

I know everyone is saying the embacy in manila isnt being that strict right now but i still feel i have the whole world on my shoulds applying for k1 with not enough income and using a co sponcer. I talked to a buddy that runs a youtube channel.called yuri tv and he said hes heard mixed things about co sponcer aswell

IF i was a betting man, and I do like to bet.

 

I would say after you get approval on your K1 visa in Manila.  The CO (Counsular Officer) person who does the interview with your fiancé and you if you want to attend, They will ask you about 4 questions and boom approved. I don't see you needing or them asking for I-134 paperwork or any type of supporting evidence for money earned or you needing a sponsor.

 

 

Just when you think you have TDS eradicate,  a new case shows up.

You truly believe that?

 But i should still have all the documents with my income and my co sponcers income paperwork..

So even if they dont ask for it does that mean i wont need to prove i can get above the 125% when we do adjustment of status?. 

I dont plan on being there for the interveiw because i plan on going back this year then ill need to save for the k1 process and her travels etc...

That is the most likely outcome. They rarely (but not never) ask for the I-134 there right now.

For AOS, the I-864 is required and they will require the 125% income level as a bare minimum. No way around this requirement.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And thats where my sponcer comes in and saves the day.

Its truly silly and depressing i cant even make the 125% $20,600 dollars in a calender year... Truly i had goals to.get my GED this year and take EMT classes but now im just going to be working as much as i possibly can to try to.hit that 20k mark on my own ...

 

If a k1 visa is denied or the AOS is because of income but in the futire someone meets the requirements can it be filed again?

 

 I am being told by everyone that im way overthinking this and that my sponcer will mostlikely be accepted.

If there is not a capable sponsor for an I-864, then AOS must be denied under the INA.

If the K-1 was refused, you would be issued a 221(g) to provide a satisfactory I-134/sponsor. If that was not done so before the I-129F's approval expires, then you would need to stat the process over again from scratch. But yes, you could refile.

If AOS is denied due to not meeting the sponsorship requirements, and no NTA or deportation order is already issued (unlikely but possible), you can refile. Just note that any AP and/or EAD issued as a result of a pending AOS application is revoked upon denial of the AOS application. Typically, they will issue an RFIE for an unsatisfactory I-864, which halts the EAD/AP from being approved in the first place.

For AOS he is borderline right now at $25k/year. USCIS IOs are usually not to strict, but this would still make me a bit worried personally (I'm risk adverse).

Yikes!!!  That would be devastating for most couples.... and the entire process would have to be replayed.....with no refund of already paid fees...sounds pretty risky to have a borderline I-864.

Correct.

They would typically RFIE for a satisfactory I-864 first, and maybe even a second RFE/RFIE if the response was still unsatisfactory. But eventually they must have one or the case cannot be approved.

So ur saying my sponcer inly making 25k is risky? Even if i make around 15?

The current bare minimum requirement for a household size of 3 (him + his wife + the person being sponsored) is $25,525. under this line, AOS (or a CR-1 visa) cannot be approved/issued. Above it, it's up to the IO/CO upon looking at the totality of the circumstances.

If he makes $25k/year, this is borderline at best. What you make is irrelevant if you use a joint sponsor.

Personally, I'd suggest looking at a second job, even if it's only part time and at least until AOS is approved (or the EAD is approved if they start working). For your household size (2), the income requirement is only $20,300. An extra $5k/year is only ~$96/week...~13 hours a week at the federal minimum wage. I'm not saying this is easy, and more hours/higher wage is preferred, but I do thin kit's worth the consideration.

Well looks like im screwed. The job im working now is a temp job i need to find a permanant fulltime job aswell as a part time job and make 20k in like 10 months...

Starting to wonder if i should move there for awhile maybe it will help with getting her here idk im so stressed now.

She only has 6 months to stay on the k1 visa so idk how she would be able to work like someone said.
