Only costs $160 to try, but highly doubtful she'll get a B visa to visit.

I read if i have 5k + i can sponcer her tour b2 visa..

 

But i mean do u guys recommend i use a lawyer to help with the k1 visa process or ate there other peole out there that can help with the k1 paperwork?

A B2 visa is requested by her.  You, the USC, have nothing to do with it. 

 

She must prove that she has strong ties and will return to the interviewing officer at the embassy.  Job, house, other strong ties help.  Single, young Pinay with USC boyfriend don't help :)

 

The process is not that difficult to complete a K1.  Its just following directions.  

 

Given your stated financial situation, I believe spending money on a lawyer to fill out paperwork for you (as that's all they do, you still have to chase all the required documents), would be a waste of your limited resources.

She has almost zero chance of getting a tourist visa. 

 

Can you move to Philippines and start a life there, spend a few months or longer there. 

Just when you think you have TDS eradicate,  a new case shows up.

There is no sponsorship for Tourist visa.  Nothing a US CItizen can do, except pay for the application fee

Have to agree with everyone, young, single... hard to get a tourist visa. Not impossible, but definately not easy.

 

Sponsorship from the USC does nothing, in fact can be detrimental as they would see she has a close tie to the US meaning she might not return to the Philippines, that alone will cause denial.

 

We all understand the importance/desire/want to not be separated from our other halves, but at the same time a lot of thought, time, preparation and planning have to be done. This includes financial situations.

 

While it is up in the air on the whole co-sponsor for K-1, I myself had heard it is case by case (mostly like the USC is a recent college grad and such)... also it is true that a lot of times they haven't asked for the I-134 form from the petitioner, but they still do see your original I-129f petition where you already listed employment. Naturally if you have one long term job it looks good. If you have 4-5 short term, low paying jobs, they may be more inclined to ask for it to confirm your ability to sponsor. Again the co-sponsor seems up in the air and maybe there is no correct answer on "yes or no"; but I always say, go into this fully prepared, not just betting off others information because we all know there are a lot of conflicting things about.

Ok so tour visa is a no go.

I read there is sponcership for b2 tour visa need to show bank statements letter of invetation alphadavid (dont know correct spelling) of support and 5k or more in my bank account..

 

But thank you guys for clearing it up about the co sponcership that attorneys office cant be that good if they dont know this stuff... Like i said im going to do everything i can to meet the 20k for her the 125% above povertly level if i dont make enough my father will co sponcer i guess i just need to hope pray anything that it will be accepted... Ive thought alot about saving for acouple years and moving there but there is no jobs for americans there honestly. If their are they pay aboyr 500 peso a day. :-(

USEM very rarely asks for the I-134, but they still might. A co sponsor is accepted on a case by case basis.

 

If you marry and do a CR-1 visa instead, you would use the I-864. They will accept a valid joint sponsor in this case. It's also a cheaper path, and only a couple months longer to obtain, so it's worth consideration.

We have thought about it...  Can you tell me what the total income requirement would be if my dad joint sponcers the cr1 he lives with my mother and me living on my own...if u could tell me the total income requirement it would be a huge help.... Because if the k1 is denied because they wont accept the cosponcer this is our other choice but no one can give me a direct answer of the total income .... 

If someone could tell me it would be very much apprichiated

Do you.think.its best to.just do.the cr1 or try to do.the k1 first with him as a cosponcer and if its denied then go for the cr1? If we do.the cr1 i could do it much sooner because hes on disability income which i know can still be used as cosponcership or jointsponcer and since its disability income its very consistant

If you live with parents you use the value for 4 people.  Have to count all in the household.

 

If you live on your own its just you and her, so use the value for 2.

 

Can't comment on what's best for you.  We did the CR1 route back in 2015 and it was 8 months from filing to Visa issued.  Those numbers don't apply today.

 

Keep in mind, if you do K-1, in addition to the extra AOS costs, she won't be working or driving for several months.......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I hope she knows about your incarceration and dependent on the situation you will have to acknowledge this on your petition
