For k1 case by case but we desided the cr1 is best and they accept sponcers for that...

 Are you sure we can combined incomes with him as a joint sponcer? Because if u go back acouple pages a few people said it is not possible for us to combined incomes at all.

If you marry and do a CR-1 visa instead, you would use the I-864. They will accept a valid joint sponsor in this case. It's also a cheaper path, and only a couple months longer to obtain, so it's worth consideration.

Incomes can only be combined between a sponsor and the other individual via an I-864A. Unless I'm mistaken, that doesn't apply here since the petitioner and father as they do not live in the same principal residence.

Assuming that's still the case, the father would be a joint a sponsor instead. Separate sponsors cannot combine incomes.

I live witg my mother and father..  I was only going to get my own place so i could meet the minimum of 2 in household $20k

So since i live with him... Would my 15k and his 25k be enough for 4 people in this household and we can combined incomes my father and i?

Hmm okay...this gets a bit more complicated then. Sorry if I missed that earlier (it's 12 pages long now!).

 

What you would do is be a sponsor via an I-864. Then your father would complete an I-864A. His wife should complete one as well (they like to see them both usually). Then you can combine the income between all 3 of them. At the same time, the household size would now be: you, the father, the mother, and the beneficiary. For that household size, you would need a minimum income of $30,750.

My mothers income doesnt count she has an under the table cleaning business.....

 

:-) so my father and i can join incomes and meet the requirements for the cr1?!? I reallyy hope this is true. If so you just made my life ....

You will have to declare all income, is your mother going to lie on the form and say she does not have income? :wacko:

Technically she doesnt .

Why would she need to fill out the form if she doesnt have an income

He said "they like to.see both usually"..

She should fill out an I-864A, but it's not strictly required. It's up to NVC or the CO if they want to see it or not, but they have done so with some others in the past.

 

Regarding under the table income, the income shouldn't count anyway as there's no evidence of it. As for whether or not to list it on the form, I can't say for sure. Below are the rules from the instructions (https://www.uscis.gov/system/files_force/files/form/i-864ainstr.pdf):

"Item Number 1.a.-1.d. Your (the Household Member’s) Employment.

Select all boxes that apply to you. A sponsor may not rely on a household member’s income from illegal activities, such as proceeds from illegal gambling or drug sales, to meet the income requirements, even if the household member paid taxes on that income.

Item Number 2. Current Individual Annual Income.

Enter your current individual earned or retirement annual income that you are using to meet the requirements of this contract and indicate the total on this line."

 

The bolded section, to me, reads as not having to list income if you are not using it in the contract. But I am not a lawyer, so i will defer to others here.

Ok, along with the i-864a what els would they need to include with the form.. Tax returns for last 3 years? No bank statements right? As my mother does have bank income proof of her depositted paychecks ...
