  • s/he has committed only one crime involving moral turpitude; and

  • s/he “was not sentenced to a term of imprisonment in excess of six months (regardless of the extent to which the sentence was ultimately executed)”; and

  • the offense of conviction carries a maximum possible sentence of one year or less

That sounds confering. I hope everything goes well. Thank you for your help and time.

I have another question based on my same case, I think I mentioned but here I go again. My mother entered legally with out inspection and stayed for almost 6 months, she entered by land and left by land. During those 6 months she had the Petty Theft issue.

Will her illegal entry and stay for less than 6 moths play any negative combination with her court record?

Thanks

What evidence does she have that she left?

Or when she arrived?

How are you going to substantiate she was here less than 6 months?

If it wasnt for her criminal record it was like she never was in the USA .. lol most people leave by airplain . Not in her case she went back the way she came.
