Hi VJ,

 

I'm on my OPT working fulltime since Jan 15th 2018, and I've married to my wife (USC) this January 2018.

 

We both just graduated for our Engineer bachelor, hence my wife has no income at the moment, and her income from part-time job in 2017 and 2016 is not enough for the poverty line.

 

My annual income is way pass the line. However, my question is,

 

1. What evidence can I submit for the 3 months worth of paycheck (once every 2 week), since I only start my permanent fulltime for < 1 month.

I've been with the same company/employer/manager during my summer intern 2017, part-time CPT from 01 Oct to 31 Dec, 2017.

One option I can think of is, I can submit my part-time paycheck during 2017, and whatever I currently have (about 2 paycheck), then later if there's RFE I can submit the next paychecks. Is this legit ?

 

2. W2 and 1099 when filing i864. Is this include both my wife and myself W2/1099 or only my wife who's the petitioner/sponsor.

 

3. Recent Tax Year should be 2016, is this correct ? I did my homework and people say, 2017 tax year deadline is April, which is not there yet -> submit 2016 tax things. 

 

4. Will the tax return be count as the income evidence ?

 

5. For Part5. Sponsor's household size >>> #8. household size is autofilled. Is this correct in my case ?

So my wife is sponsoring me (intending immigrant) -> 1. is 1

She's currently married with me -> 2. "1" for the spouse

But "add together part 5 number 1->7", it is not "1" as autofilled.

1. You can ask for employment verification form from your HR/manager. This typically has information of your salary. Please note the following from the I-864 instruction:

If you included the income of the intending immigrant who is your spouse (he or she would be counted in
Part 5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after obtaining lawful permanent resident status, and the intending immigrant must provide evidence that he or she is living in your residence.

 

2. If you include your income, then you will also need to include your W2/1099.

3. Yes.

4. Yes, but if it's not IRS official transcript you will also need to include W2/1099.

5. Leave #3 blank and change #8 to '2' (wife + you)

Thanks buddy for the reply.

 

For part #1, the evidence of support. I'm aware I need a letter from my manager/employer. Should this be parallel submitted with the paycheck ? Or only need the verification and no need the paycheck. I read it as 2 different thing that have to be submitted parallel.

 

Btw, for the medical exam, is it better to do it once when submitting the AOS application package, then do it one more time before the interview date to avoid RFE ? I dont mind about the fee.

No problem!

 

Yes, do a parallel submission with the paycheck (these are not required document, but good supporting document)

 

You're not required to submit medical with your AOS application package. Not including medical will not delay or prevent you from getting EAD/AP/interview.  Hence, it's advisable to get it done once you receive an interview notice.

 

Obviously, you can get the medical done twice if you opt to, it's your money, time, and energy after all.
