Hi, I have a question on applying OPT while green card (family based) is pending.

 

Here is my situation. I am a PhD student graduating Spring 2018.

I am currently holding F1 visa and married to a US citizen.

Thus I applied green card applications (I-130, I-485, I-765, I-131) on August 2017.

As of 02/05/2018, the green card application is still pending.

Received job offer starting July 2018.

 

The question is that am I eligible to apply OPT?

just in case the green card is still pending at the time of the appointment?

 

Any comments will be very appreciated!

I think applying for OPT will be a waste of time and money, because you applied for I-765 last August.

What's the case status of your I-765 and I-131?

You might still be eligible for OPT, because you haven't use AOS benefit. But, you already have an immigrant visa pending, so you might not be able to apply for it. Regardless, it's better to worry about your I-765 from AOS than OPT. Especially, OPT is not free and is restricted, but EAD from AOS is free and can be used anywhere.

12/09/2017 Received Biometrics Appointment Letter (for i-485 and i-765)

12/21/2017 Biometrics Appointment

01/08/2018 **I-765 and I-131 Approved** (61 days)

01/16/2018 %%Received combo card%% (tracking shows USCIS sent it on Jan 11 from MO, then Jan 15 USPS closed for MLK day) 

01/20/2018 Received approval letters for EAD and AP

09/20/2018 Received text 'Interview was scheduled' and interview notice will be mailed

09/27/2018 Received Interview notice by mail

10/25/2018 Interview day

10/26/2018 I-485 case status updated to "We ordered your new card"

10/29/2018 Case Status updated to "We approved your Form I-485"

10/31/2018 Case Status updated to "We mailed your new card"

11/01/2018 My card was picked up by the USPS with tracking number assigned

11/05/2018 Green Card Received 

 

Side note: I turned my maiden name into second middle name. In the combo card, my given name is First Firstmiddleinitial, however on the back of the card, they attempted to list my second middle name.

Your I-765 should have gotten you an EAD.  That's what you should be working on since your F1 isn't exactly valid once you've applied for the I-485 and I-130.  My wife was in the same boat and did her internship with the EAD.  You can always switch to the green card once it comes through.

AOS 2017 (I-130 & I-485 along with EAD/AP)

02-16-2017: Package sent.. the wait begins

02-18-2017: Package received (based on tracking)

03-01-2017: 4 Emails received with case numbers

03-06-2017: NOA's received (4 in total), priority date: 02/21/2017

03-08-2017: RFE received for missing name on Affidavit of Support

03-16-2017: RFE responded (we were away when the RFE was mailed)

03-21-2017: Biometrics appointment

03-22-2017: All cases online were updated online... wait really begins

EAD Drama

05-19-2017: EAD still not received.. put in request to expedite due to job offer

05-24-2017: USCIS emailed to wrong email apparently, faxed in additional details as requested

06-07-2017: EAD approved

06-09-2017: EAD card "mailed"

06-12-2017: EAD actually picked up by USPS based on tracking data (from Missouri)

06-13-2017: EAD delivered via Priority Mail (to NYC)

Interview (NYC Field Office)

12-28-2017: Received request for initial interview on 01/30/2018

01-30-2018: Interview at the NYC Field Office

01-30-2018: Online status changed to "New Card Is In Production"!! (349 days from when we mailed the package out)

02-02-2018: Online status changed to "Card Was Mailed to Me"

02-05-2018: USPS Tracking shows card is actually on the way (from KY)!!

 

ROC 2019 (I-751)

11-04-2019: Package sent.. the wait begins (86 days before expiration)

11-12-2019: Text message received with a EAC (Vermont) case number showing the packet was received on 11/6.. waiting for physical NOA.

09-04-2020: ROC Approved

09-20-2020: New card received (10 years!)

 

N400 2021 (I-751)

03-14-2021: Online application sent

01-04-2022: Interview Letter Received

01-27-2022: Interview, Approval, and Oath Ceremony. Certificate in hand!
