Illegitimate Child Law Philippines

Timeline

I will be US Citizen soon. I have a 9 yr old son who will derive citizenship from me. I will apply for his passport and one of the requirements is an evidence or proof you were in a legal and physical custody of your U. S citizen parent.

My son is born out of wedlock but his father signed on his birth certificate and my son have his last name. But according to Philippines Family Code that the parental authority including custody will be on the  mother of an illegitimate child. I will have his father sign a consent DS 3053 form too. The father stop supporting him since I met my husband 6 years now. No communication between father and son. But I know where to contact him but I will never bother for that is not my problem anymore :) i only emailed him  to ask to signthe  form and  He said he will sign the consent form.

 

Anyone here have the same issue. Does DS3053 Statement of Consent enough?

10/19/2018- Submitted Documents. Civil Documents/AOS and completed DS260

10/30/2018- received email from NVC. checked my CEAC acct rejected AOS, Police Clearance and Birth Certificate

Reason: some part is cut off and not clear. Resubmitted the same day.

11/08/2018- Received an email from NVC that all the required documents are approved. Its documentarily qualified and they will schedule the interview.

11/19/2018- Received an email that interview is scheduled for December 17

11/22/2018- First day medical

11/23/2018- Second day medical saw abnormality on the xray need to go back for sputum culture.

1/31/2019-Back to St.Lukes. Medical approved. Scheduled Interview 

2/08/2019-INTERVIEW PASSED

2/13/2019-Visa Issued Status

Hi! 

 

I just finished going through the process of proving legal custody of my daughter. I was married to her father and divorced him here in the US. It will help if aside from the DS3053, you get a notarized letter from the dad that he knows and doesn't object to your current custody arrangement  and the release of your child's passport and your travel plans and that he supports all your decisions regarding your child. You also need to contact a lawyer from the Philippines to write a letter that states that the law when in comes to custody of an illegitimate child in the Philippines.

 

We were once denied for the passport of my daughter because I only submitted a few paper works and then the DS3053. It can be a difficult process but it is what it is. I applied again and after 6 months, we now have my daughter's passport. Too much back and forth but don't give up on your paper work and you'll be fine.

01/18/11 - Received Green Card in the mail..

Did you include anything about family code article from Philippines?

No. Thats all I submitted. If you apply for your kid’s  passport and only one parent is present you need the form which is a consent that the father or the other parent allow you to apply for your kid’s passport. He need the consent form get notarized too
