In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Wonder how he has supported himself and now a family for 11 years

if he is working illegally,   this also needs to be told to the attorney as that really complicates the case

no green card

no ss number

no tax returns

no driving licence

how many laws are broken here?

I do agree that real names on any forum is a bad idea.

 

Also---*can* screen names be changed on VJ, or would a new account have to be opened altogether?

A poster can change his/her screen name.  All of the old history just follows the new name......I have never seen the benefit of anyone using a real name as the screen name.

Okay, name changed. Thanks for all the feedback. We are well aware of our situation as well as what the outcome could very well be. The attorney knows every detail that complicates our case even more. We have been very open with her about this. We have to start some where even if that some where leads him back to El Salvador with a 10 year ban. We are hopeful (with hesitation) that we can do this without breaking our family up for a very long period of time. I have not walked into this process blind. All we can do is try. Applying for the petition didn't just suddenly give them our location, names etc... The same address that was used for his initial proceedings with the voluntary departure after he was locked up for driving without a license is the same address we live in now. While I understand it may have put a spotlight on us...

 

We do border a Sanctuary City. While it won't help our situation it may protect him from being detained during a traffic stop or from being a target to local police there.. We do worry over  the 3 miles he has to travel into our county to get home each and every day.. but that is apart of being in our situation... eyes wide open...

Good morning. Please let me say the following first: I do not know the details, I do not want to hurt anybody's feelings and it is NOT on me to judge anybody for their actions. But I sometimes get a "weird feeling" of discomfort when I read through threads like this one. And yes, I also understand that LOVE, FAMILY and HAPPINESS stand above all......except for the law.

 

Obviously this man came here illegally. Millions do. And I do not support that at all since there are legal ways to apply for entry/residence. But besides breaking the immigration law, he drove without license, got caught by ICE then lied to authorities, when choosing voluntary leave and staying. And now you hope for a way for this to just go away and not be an issue when trying to adjust his status?

 

I do not see any way for him to be adjusted. And if you find a lawyer that CAN get this done, it will cost a huge sum of money to achieve.

 

With all this being said, I still wish you best of luck and hope you will find a way to legalize his situation.

With lack of better a better word. Yes, I am hoping we can fix this. Hope is all we have at this point. I do not expect it to disappear like it never happened. I am well aware of the laws broken here. 

 

We have tried to prepare to the best we can for whatever is coming our way. We have to start some where. Well, we don't actually have to. We could continue to live the way we have been.  If you look at his entrance, living/working/driving situation - his case isn't uncommon. It is however once you throw the voluntary departure into it.

Sibca04, stay strong and consult an attorney whose specialty is deportation. There might be a waiver he can file while in the US, then he would still Need to Leave the country But With the waiver he would permitted to reenter.

My question: did he get the i130 Approved without an Interview In front Of An Immigration Officer?
