Seems to reason the i-130 filing will have now brought him to USCIS's attention in a huge way...start a chain of events if presumably after the denial letter comes the NTA letter.

NTA not needed he has a Deportation Order against him.

Ah true.... forgot it's automatic deportation order after his failure to voluntarily depart.

 

If OP's husband is still driving without a license, he's begging for trouble if he gets pulled over again/stopped for a traffic violation.

If he departs now, there will be another ban from the US that would go into place which is diff.. for up to 10 years.. 

You may be correct but that's why your paying for a lawyer to try and help you because this will be a very difficult case to say the least. You better hope that the alamance county sheriff won't catch y'all because you know how he hates and goes after illegals that are breaking the law. So your husband better not be doing anything wrong right now. 

 

Also this will not be a easy case and it will take several years at least for this to be complete.

If they do have insurance it ain't worth much at if they hit you. I found that out from experience.

I don't believe you have any options that don't involve leaving the US for a substantial amount of time. 

 

The only real question is does he want to depart willingly or wait to be removed by ICE, which will be unpleasant.

Also, i suggest calling a GREAT waiver lawyer! lizz cannon gives free advice! she is amazing:) google her and tell her your ENTIRE story and she will know what to do or if anything can be done!!!!!! you need a specialized waiver lawyer! also laurel scott but she charges more and lizz cannon worked under her. they are the two best! give lizz a call!

That is my supposition, failure to use Voluntary Departure when given the opportunity does not bode well.
