This was in the fine Print

 

  The new UCR SRS definition of rape does not change Federal or state criminal codes or impact charging and prosecution on the Federal, State or local level, it simply means that rape will be more accurately reported nationwide.

From what I read he would perform bimanual exams ungloved with the parents in the room. Not impossible since they would be at the head of the exam table, and you would use a drape for the young woman's privacy. Creepy and disgusting.

 

What I don't get is how he convinced these young girls and their parents that they needed bimanual exams in the first place. He was a sports medicine doctor, not their OBGYN.

A) Why is a sports doc doing said exam?

2) Why would anyone allow such without gloves??  I mean the parents here.  The girls may not know any better.

1) I have no idea. Even an OBGYN in this age range does not need to perform bimanual exams (At least from what I recall in medical school). I don't think ACOG or the ACP support routine bimanual exams, even in adult patients (when they are asymptomatic and not meeting requirements for cervical screening). In adolescent girls a visual inspection would be all that is required generally, and that would just be to assess tanner staging. Even that though wouldnt' be a sports medicine doctor. I don't see how he rationalized his role in that scenario, though clearly he did and was clearly very manipulative. 

 

2) I could see it happening. With the drape positioned appropriately the mother (or father) may not notice based on their angle of vision. If they are sitting at the head of the bed. A parent usually doesn't stare in that general direction (if they are even in the room) because their daughter is probably embarrassed. Many young girls would request a separate chaperone instead of their own mother because of embarrassment, and clinics are required to be able to provide those (usually a nurse or medical assistant that is female). Those women would stand in the corner of the room, and would probably (hopefully) notice that he didn't put on a glove.

He's an osteopath, that's really not true sports medicine in terms of a physical therapist... And strangely enough, some of them do... ''procedures''  of that nature. Will not go into graphic detail here. http://www.mlive.com/news/index.ssf/2017/02/what_was_portrayed_as_medical.html Not a doctor, but I can see how such ''alternative therapies'' would be rife with abuse.

He is a DO, I believe. A DO can end up going to the same residency as an MD, and can end up practicing medicine just like an MD in the exact same practice setting.

 

I believe I read he did a Family Medicine residency, and then did a sports medicine fellowship. So he isn't a therapist, he is a physician that would see patients for sports related injuries. As a DO he may put a "natural" spin on some of what he does, but most DO's I know practice medicine in exactly the same way as an MD does. We have DO surgeons, OBGYN's, Pediatricians, Neonatologists etc...

If a mother/father was present in the room you wouldn't necessarily need a witness. You just need someone (either or). You'd usually ask the girl her preference.

 

Honestly though in my experience the nurse isn't attentively watching the details of the procedure, to respect the privacy of the patient. They will usually talk to the girl, to make her feel more comfortable and to "distract" her. Often times they will be positioned at the head of the exam table just like a mother would, so their view may be obscured by the legs in stirrups and a drape.

 

Though I would say even a nurse should/could have questioned why he was doing these exams. Unless he was acting as a "Family Physician" for these girls, he really has no indication. Even as a Family Physician, a bimanual exam in the age range that he saw these women would not be recommended.

He wasn't doing an OBGYN exam though. He was doing something called OMT, which seems pretty gross to me. If those in osteopathy view it as something 'normal' to do, why would a nurse question it? He'd likely say it would help their pelvic wall, or core, or alleviate pelvic/hip/back and other pain a gymnast would have.

I thought I read he was doing bimanual exams?

 

I don't know anything really about the details of OMT, but I've never heard of it involving actual penetration. That is some f'ed up stuff.
