Gayle&Angelo, I'm at the K1 phase so I cannot answer.

I do believe that at AOS the adjudicator tends to be stricter.

I get the sense that he/she will want to see either income from the American of the 125% and/or assets x 5.

Money that he may be earning, if placed into a communal account for over a year "may" be considered, at least I'd consider it. But monies that are in his account, with you not having either 125% income via job or 5x assets (or a combination) I would fear being a "no-go."

I'm "sweating" that possible scenario two years in our future. I'm an RN but I have a back issue. It's been excellent (meaning not interfering with work) for over a year so things look positive. But should that re-occur and put me out of work for six months or more, then what? "We're sorry but your wife must leave America because you, the American has become injured?" Nasty but seemingly probable.

Trying to be creative I've decided, well,, I live in a triplex (three apartments). The two rents break-even with costs such that I live here pretty much free. I also have a 2nd house--if I fix that up I can move from the triplex to the other house and rent the unit I had occupied, and now I have about $15k/year in rental income, all provable by bank deposits and leases. I'm thinking that might shift the balance, if necessary. I'm also studying to do case management and intend to become certified in a year or two. That opens opportunities since many case managers work from home and there is no lifting (other than a phone).

Danju's question went unanswered and it seems that there is little interest in this thread anymore. You might want to try posting in a AOS forum.
