On my current taxes for 2017 my oldest daughter is being claimed as a dependent because I supported her the entire year.  She has moved out the first of this year 2018 and is on her own and I won't be claiming her as a dependent on my 2018 taxes.  On the form I-134 do I have to include her?  Obviously if I don't the financial requirements will be less and this would be very helpful when my Fiancee' arrives and we file for her Adjustment of Status.  Also, I work a side job that is not reported on my taxes but I would like to include that income.  Should I, or just not include it since I did not include it on the tax return?  I can get a letter stating how much I make and deposits from bank.  Thanks any help would be appreciated.

you have to file your 2017 taxes (2018 taxes will be filed in 2019). Your daughter was a dependent during 2017, so you have to claim her.

 

My daughter moved out in july of 2017. While i technically COULD claim her, I am not. easier for the taxes and for immigration not to.

 

If you are worried about the income limit, dont claim her. she can file her own taxes and claim herself.

 

As for your undocumented income... I will not advise on that ;) The amount I am claiming on my affidavit of support, will be the same amount claimed on my taxes (and it comes from various sources - job, pension, trust fund).

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
