k1 is usually too “simple” for immigration lawyers... I just read I think in august topic, that the lawyer didn’t fill out the beneficiary’s address correctly... lots of problems with lawyers..

 

but the good news is timelines lines are getting better :) October will hopefully start this week and that’s way faster than the time july or August waited to start!

Hahaha. I just read the same one. Haven't posted a lot of forums. Mainly just troll and get info as needed. Don't wanna ask questions that can normally be found with just a little work.

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

Yup! Hopefully things start to pick up pace again. Last year when I filed, I witnessed the average jump from 4 months to NOA2 in the Feb to early March group to 5 months for the late March group (me).

 

Last time I used a service called Rapid Visa, much cheaper than a lawyer but essentially fills the same function. This time I did everything myself since they actually simplified things a bit with the updated form, but of course lawyers will still charge the same rate! :D

Has anyone been able to log into the new system and see the processing times specifically for your case? Or is that still in the old tracking website? I'm finding that even though I have an account under the old system, it won't accept my login for the new one. Any ideas?

I downloaded the app. Which u can be redirected to the website also from there.

Hi all,

 I used a lawyer to file our K1 paperwork just because my fiancé is from Venezuela and I know they are terrible with paperwork and everything. SO I asked the lawyer today if it would effect our case if he applied for a B1 visitor visa to come spend some time with me and my family this summer to attend a few family events, weddings and important birthdays, and she said he would probably be denied. Does anyone have experience with this? I feel like that is a little crazy, but then again it is the government. He did get denied for a B1 visa last Sept because he did not own land in Venezuela. I would forward him the invitations the are addressed to both of us as proof of the events.  As of now we have been meeting in Aruba, and will travel to Cuba next month to spend some time together.  Would really love to have him here, even just for a little.

My fiance was just here alittle over 2 weeks ago. She didn't have any issues at all. Shes also planning on visiting the end of Augest for a week or 2. She may even be here when noa2 shows up😁. Needless to say traveling from the U.K. to USA is hardly ever a issue.

B1s vary quite a bit from country to country. It isn't guaranteed that your fiance would be denied, but it is highly likely due to the socioeconomic status and political climate of Venezuela. It's much easier to get a B1 visa from countries that are closer to the same as the US as there isn't as high a risk for overstays. He would have to prove a very strong tie back to his home country that would ensure his return, and having a fiancee here in a the US might weaken that case.

I think, based on your circumstances, that a B1 denial is very likely. However, it wouldn't hurt to apply. I've read reviews where a B1 denial helped at the K1 interview because it demonstrated that your fiancee made an effort to visit you in your hometown, even if that effort was unsuccessful. And, if you get approved, then it goes without saying that that is good news!

The B1 is a non immigrant visa and with those you have to prove intent to return to your country and because there is a k1 petition they will see that he is obviously is not intending on returning and it will be denied. If he already had one it would be okay but because he does not a pending k1 will be automatic denial and it’s not cheap to pay the fees for the application and ds160 I would not even waste the money or time the lawyer is right but I understand how you feel and wish all the best

I have seen at least 3 people who got approved for b1 while their k1 was pending. 

 

One of them even travelled in between noa2 and NVC.

 

need to show ties (strong ties), be open about k1 and show that you are doing the right way but just want to visit.

 

it may go to waste or may get approved. But even if it gets denied due to not being able to show ties etc. it won’t affect your k1 process.

I have a b1/b2 visa (remember, that b1 is for business but when you are not getting paid, <like a meeting etc> and b2 is strictly for touristic purpose). I don't think they separate these often though. I needed b2 only.
