Well I just checked the old site and it says an RFE was mailed Aug 30th (today). So I guess no good news while my fiancé is here -- he comes tomorrow. I just cried for an hour. I am SO SICK OF THIS WHOLE THING!!! I spent WEEKS on this application. Can't imagine what it is.


Two questions--if it's something simple and I can send it right in, then how long until we are approved? My fiancé already gave notice for his job and apartment. So just trying to get a sense of the timeline. We don't get it until September (and of course no mail Monday...of COURSE) and we reply by end of the week, then maybe two more weeks for approval? So not even approved until end of September? So I'm thinking he would not get the interview until middle of December? Am I on track?

 

Second question--do they ever DENY after an RFE? I mean, could this just be over? I have literally NO idea what it is but now I'm nervous. Just need a sense of what's coming. Ugh.

Unfortunately, no. You just have to wait for the RFE to arrive in the mail to know what the issue is.

I'd use the Igor's list tool to get an idea. Change the default setting next to "Show" from unapproved to approved, and compare all the dates with RFEs.

Don’t worry it will be like two weeks if it’s simple and if they were going to give a denial they would have just done it it’s better to have a RFE then be waiting and hear nothing now you can just send it and then get approved and move forward don’t worry nothing ever stays the same as my grandmother always said you will get through this rooting for you

This is so helpful, thanks. Looks like anywhere from 2 weeks to 3 months. So knowing my luck, I guess we'll expect 3 months!

Approval once receive normally is 14 to 60days but, have seen some even sooner then this. 

 

Yes they have denied after rfe for not supplying requested info and failure to sign rfe that was sent back.

 

dont stress over it.. its gunna even something simple and a quick fix, send back next day air..

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

I got the same email yesterday and today logged into the old site to see it says an RFE was sent today. I guess we are in the same boat. NOA1 Feb 16th so it's been a LOT of waiting only to find out it's going to take even longer and who knows why!!

True. Part of me feels like waiting three or four months for him to actually be here, after all of this time, is nothing. The other part of me is just crushed at the idea that we will have at least a month more than so many others here. It's just cruel punishment. Swear I'm a good person lol, but I just can't catch a break.

About RFE's

 

When you receive an RFE (Request For Evidence) the best way to handle the RFE is to read it carefully. Do ONLY what it says. DON"T add tons and tons of unnecessary documents. It's not needed and will NOT help your case. The adjudicator has already made up their mind about your case and if you do what they ask then they are going to approve your case. Of course if something in your past is hanging up the approval, hence the RFE then what you return will answer the question(s) that the Adjudicator has.

 

I'll give you an example. Recently a couple had filed a I-129f and they received an RFE because a question was not answered. The question was "have you every been arrested" or something near that. Forgetting about a expunge case in his youth he thought he was being honest and said "no". Well the RFE was returned and the adjudicator denied the case because it answered the question "no" when he should have answered it "yes" because of the expunge case that he forgot about. So, he had to return back to his fiancé's country, marry her, and then return to process a visa for her under the I-130 which is a CR-1 visa (spousal visa).

 

Also, sign your RFE where it ask and if it doesn't ask then sign the copy of the RFE that you will be returning. Sometimes they ask and sometimes they don't. We had a case here not to long ago where someone forgot to sign the RFE when requested and BINGO.... Denied! So sign even if it doesn't ask for it.

Wow, that didn’t add a whole new layer of stress or anything lol. So basically what you’re saying is we are one tiny mistake away from this whole process being a complete and total waste of time. Awesome. The next month is just going to be fantastic and stress free! Yay for those of us unlucky ones!

Call USCIS. Tell them you would like a copy of the RFE faxed to you because you are on a deadline that can’t be extended. A tier 2 is the only one that has access to those systems. They can also read it to you and let you know what they are requesting. This sometimes works and sometimes it doesn't. But give it a try.

In the new revised I-134 form dated 2018 - Question #38 now regards contributions.  You leave the yes/no boxes "unchecked" and your explanation is submitted in Part 7 on page 8 of the new form.  

 

You will do this:

3.a. "Page 4"

3.b. "Part Number 3"

3.c. "Item Number 38"

3.d. "N/A (K1 Visa Process For Permanent Residence)"

 

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.
