Husband in German Military, Complications with forms. Please help.

Hello All,


      My husband is a member of the German armed Forces and he's stationed here in the US. We recently got married in October of last year and right now he has a NATO2 visa. We are not sure if we are going to stay in the US after his Service bit it's a possibility. We Met in April of 2016 and moved in together in January of the following year. He asked me to marry him in February of last year before he flew to Germany for Training. When he returned We went on vacationed there in March. Then a few months later he traveled to Turkey to work on an airbase there. When he returned we got married. We have talked a lot about whether we want to stay in the US or not and honestly It would be easier on both of us if we stayed here. His tour of duty will be over at the end of July of this year but  he will still be under active duty for the next 2 yrs unless; he takes time to go back to School which is his ultimate Goal. He will continue to be paid by the German armed Forces for the next 5yrs so he can go to School and Support himself.

     So our questions are: What forms do we Need? We have already filled out the I-130 and the I-130 A and we are working on the I-485, but we are unsure of what other forms  we Need. Also what Kind of Problems will we run into since he left the Country twice before we got married? We also Need to know if it would be possibe for him to start School with out a visa, or if while our paper work is pending  can he get a temporary visa of some Kind. Also when he applies for an adjustment of Status will that cancel out his NATO2 visa? We also have the Problem of my income. I do not make enough Money per year to qualify as his Sponsor. He actually makes more Money then I do but, he is paid by Germany. So given that would it be possible for him to Sponsor himself? Or can we Combine our incomes on the form? Have you run into or had any Situations like this yourself? Any advice that could be given would be much appreciated.

Hi once you filed I-485 your husband cannot leave the States anymore until his Green Card arrives. I didn't see that you filed for I-131 therefore he cannot leave. What if the Bundeswehr calls him back to Germany?

 

I don't think he can just go to school without a visa. I don't know if he can apply for a student visa at the same time. Maybe someone else has more experience with this. Same with his Nato visa.

 

As far as I know you need a co-sponsor. Will he still be able to stay with the German military once he becomes a resident of the US?

Although the NATO-2 visa permits its holders to travel freely about the United States on an open-ended basis, it also imposes certain clear restrictions. All NATO-2 visa holders are prohibited from obtaining other types of entry clearances without returning to their home countries. They may not apply for Adjustment of Status consideration or receive tourist visas. In addition, they are ineligible for certain U.S.-run programs that other non-immigrant visa holders may enjoy, including the US-VISIT program. The qualifying relatives of a primary NATO-2 visa holder must leave the United States at the conclusion of the primary holder’s business here.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
