Got divorced and now wants to petition bf via k1 visa

Hello, new user here so not sure if im in the right forum. I got divorced long story short it was a nasty break up, but i also petitioned my now ex husband three years ago and his case i believe is still pending but not sure because i no longer have any contact with him. The only person that got me through was my bf from a foreign country. Now i want to petition him so we can marry here in the US. Dont get me wrong i met my bf after i filed for the divorce. 4 questions:

1.  Is the divorce decree in California with just the fl-825 endorsed and stamped with a judicial officer valid?

2. Or do i need to go to the courthouse to have it certified and signed by a judge?I received it last month with the stamped of date stating that i am now a single person. 

3. Should i inform uscis of the divorce, or the divorce itself withdrew my petition?

4.  Can i petition my bf under k1 visa and go to his country to stay there with him?

Hi, you never responded to my last question in your previous thread.

 

Not sure about your divorce in your state. Maybe someone else can chime in.

 

Your divorce itself with not withdraw any application with USCIS. I asked you before at what stage your ex was. Lets say he's at the ROC stage. He will be able to remove conditions himself with a divorce waiver. But that's not for you to worry about. Keep in mind however you're still responsible for him financially since you signed the affidavit of support and you need to declare this in the future application for your boyfriend.

 

If you have met your boyfriend in the past two years you can certainly file for K1 and then go to his country. My ex stayed in my country while we waited for my visa and flew back together. My visa was CR1 though.

Hello littleimmigrant. I don’t know but somehow i couldn’t get back to that topic. What is ROC? Im so sorry such a neophyte. So I need to inform Uscis bout the divorce (oh i just read thats not for me to worry about) do i just inform uscis that im withdrawing my affidavit of support?

ROC stands for removal of conditions. I don't know if it applies as it was just an example. I do not know at which stage of immigration your ex is.

 

You can inform USCIS about the divorce but I don't know if it is too late for withdrawal of the affidavit of support. You can definitely mention it and see what they say but no guarantees.

When you sign the affidavit of support, you accept legal responsibility for financially supporting the sponsored immigrant(s) generally until they become U.S. citizens or can be credited with 40 quarters of work. Your obligation also ends if you or the individual sponsored dies or if the individual sponsored ceases to be a permanent resident and departs the United States.

 

Note: Divorce does NOT end the sponsorship obligation.

 

As you sent the new application you will also include a copy of your divorce decree.
