I-864 from 2015 - is new one needed for K2 who is listed as family member 1?

Hi,

The AOS guide on this forum states " I-864 - Affidavit of Support: K-2's don't require their own separate I-864 with supporting documents (tax returns, etc). Make sure they are listed in section 9 of the K-1's I-864, and provide a photocopy of the K-1's I-864 with the K2's paperwork. You don't need to include copies of the supporting documents with the K-2's paperwork. "

 

I would appreciate advice on whether I need to complete a new I-864 for the child of my husband or if a photocopy is enough? Also, would I need to submit updated financial information? Here are the details:

1. Husband came as K1 and child was a K2 follow to join 8 months later

2. Completed husband's I-864 in March 2015  - we are awaiting his 10 year green card.

3. Child listed on husband's I-864 in Part 3 as Family Member 1

4. We have had two moves and job changes since I completed the I-864 for my husband. I have been at my new job since October 2017. My salary is at a level that exceeds the requirements of the I-864 (my salary was also at a level that exceeded the requirements of the I-864 when I submitted it for my husband).

 

If I need to complete a new I-864, do I still list my husband as the "Principal Immigrant" and his child as Family Member 1?

 

If I need to submit updated financial information, how do I alert USCIS - is stating it in the cover letter and providing copies as part of the packet enough?

Did you ever get an answer on this? Could they make the I-864 more confusing? I'm trying to figure out how I don't need a separate I-864 for my K2 stepson but I am also not supposed to list him in section 3 question 2 and then as Family member 1. They could definitely make this part more clear. Thanks

Either way EACH AOS needs it's own I-864 with the person the I-=864 is sponsoring as the principal immigrant on that I-864. 

Husband - I-864 named as principal immigrant, step son counted under dependents. 

stepson- - I 864 with step son named as principal immigrant, husband listed under married.

Ok the child is under 14 and it states in the guide here https://www.visajourney.com/content/k2-visa-adjustment-of-status-tips

Just realized this thread was for February of last year oye. But thanks for your responses. Hopefully you can make it clear because this form/process I find to be very confusing.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
