Hi all, I was about to file for citizenship but seen the documents required and now thinking that I can't file. My previous marriage ended in a divorce, in which we have a daughter at the time she was 10 years old. The divorce decree said that I had to pay $xxx a month by my Ex told me that he does not need/want me to pay. For me to just buy/get her things she needs/wants and thats what we have been doing. I even pay for her to come spend tine with me as we luve in different states. Its all worked out well.

Now the problem is that they want to see proof of me paying child support when i file my N400 ( I have never worked, I'm a stay at home mom). I don't have it so now what do I do? Please help.

the child in question lives with you or him?

if the child lives with you,  he should be paying child support

I'm sorry I did not clarify. She lives with him and i have another chid from my 2nd marriage.

ok,   and having a court order to pay support / you need advise from an attorney and see if hopefully,  he will agree to a statement saying he didn't want support money

Even if you had a handshake agreement you violated a court order by modifying it and not getting the court order changed to your agreement

He is willing to give me a statement saying what we agreed to do and that he did not want the support. Will that help?

The court order needs to be modified.  His statement might help in the modification process but you need legal help first to get this resolved

No. 

 

Obeying court orders isn't optional. 

 

You would need to start paying child support, as the court has ordered you to do, before you can naturalise under these circumstances. 

 

Or you ask the judge to modify the order.

Modify the order as well as get him to drop any arrears in support from the past, some states back calculate. It's a simple form.

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

You may not need a family lawyer if your ex will cooperate. First, seek the assistance of the local child support enforcement agency as it's free....if they can't help, then move to a lawyer. I know in my state, this is the only place you can submit the forms to drop back support arrears.
