VJ family I've a question in regards to filing a k1 visa for my fiance.

 

I married in 2009 to my USC wife. Had a break down in communication after she returned. Had an affair with my fiance which later on resulted in the birth of my daughter in 2010. Travel to the U.S. in 2011 and stayed with my wife. Told her all what had happened as we made peace.

 

Everything was fine. She agreed in 2013 we file for my daughter, we did and she arrived U.S. in 2015. However, Sometime in 2013, my fiance as well was dating a dude and they had a son in 2014. 

 

I realised down the line my USC wife don't want kids, this cause great issues in our marriage and in 2015 we separate and divorce in 2016. After my divorce I reconnected back with my ex (fiance) who also had a break down in her relationship with the son's father. So we started talking and now I'm at the point of filing for k1 visa.

 

My question is what do I need to do to prepare for my case. I read alot of comments but felt the need to put myself out here for guidance.

This is very confusing. How did you get to the US? Did your USC wife petition you on K1 or CR1? Are you a US Citizen now? Is your daughter still in the US with you? 

When was the last time you saw your daughter's mother? 

What country are you and her from?

Your sex life and apparent fidelity issues aside, the only thing that matters is that one of you is a US Citizen or permanent resident, and you meet the other requirements (ie: income, in person visits, bona fide relationship- no having a kid doesnt count, etc), and that you both are legally free to marry (divorces finalized)

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

I came as a CR1. I got my citizenship based on 5 years residency . I am USC. My daughter currently lives with me. I'm from Gabon. I last my daughter mother last year April 2017.

I'm confused.  What is your current status?  USC?  LPR?

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

First off i appreciate your feedback, however Let me put it like this, I am seeking more insight from people who have been through this kind of situation and are from Gabon.  I was told by one set of people  to ask my fiance to do provide a certificate of celibacy and by others not to. That confuses me...

Then why don't you instead post in the Africa subforum and ask that specific question instead of asking about the k1 process? There are not many people here from Gabon
