2nd wife immigrant visa on behalf of usc daughter (merged)

I hv some  questions on behalf of my friend, she is a 2nd wife to a  US citizen ,they hv a daughter also ,his first wife already living in us with family, he tried to settle his 2nd family to us .. by applying for their immigrant visa.. to.He admitted fake divorce papers, after that embassy  caught the error and gave visa to the daughter on behalf of DNA and they asked the 2nd wife to submitt original divorse papers of  first wife of USC..which she was not able to provide ..the daughter went US  studied their for sometime came back to my friend with citizenship..

My qusetion

What she should do now ???

1)

can my friend enter US on behalf of USC daughter ..If yes..then what age ..she is 17 right now ?

2)

do she need to admitt some apology or fine ? After that can she apply on daughters behalf ?

3)

is she even  eligible to apply...  because  she  provided fake papers .. She was not able to provide original documents which they demanded from her.. ?

Fake documents might be considered lying to a consul which will mean lifetime ban. 

 

Daughter could sponsor mother when she is 21 years old. Thought first gotta figure out if the mother doesn't have a ban.

1) The child can petition for a parent once they turn 21 (assuming this category remains).

2) Assuming there is a misrepresentation bar, an I-601 will be necessary. Waivers must show a sufficient hardship on the petitioner’s behalf, and are generally fairly tough to get approved for misrepresentation. An apology or fine is not required (although presumably the former would be part of the waiver case presented).

3) Sure, she’s eligible to apply. But if the past fake documents are determined to have been a material misrepresentation, then she will be refused the visa (with the ability to apply for a waiver). The CO could also require the divorce papers still. Furthermore, she must show that she will not practice / participate in polygamy within the US.

Just to add to the above, apart from waiting till 21 and hoping this category is still around then, the daughter also needs to be able to demonstrate the required income to sponsor her parent (or find a co-sponsor).

Same answers remain. Can't sponsor your mom until you're 21 years old. Plus she might have lifetime ban for presenting fake paperwork.

I think that was the "friend" and this is the actual person involved...?

 

But yeah, same answers either way.

 

Since OP won't reach age of majority for another 5 years, will be interesting to see if the category for parents is even still around then.

she didnt knew what would happen its not the same thing i wanna know any other way to call her i am worried i have my studies there i wanna live with her i have my future there what should i do  like i want to take her with me so we can live there so i can study i cat live without my mom can i do something else i cant wait tell 21 i need something else why so strict why permanent ban cant we apologize why so many restrictions cant we go like i m worried cant live without my mom need her to go with me
