if your spouse out of the country has no income you are able to claim the exemption for them on the tax return adjusting about another 1500 in refund depending on the amount you made.

if you have no kids filing married not together, your tax exemption is only 6500 but married filing joint is 12,000

So i m still waiting my interview. Can my husband fill jointly because in 2016 tax filing he file as single. He thought i m not there so no need to file jointly

he can claim the tax exemption for you, but need to follow the above steps and apply to get a ITIN number he can only do this with you passport, or a certified copy of your passport. he can amend his 2016 taxes to include you, and must also include any income you made while in your country

hello Khallaf,

so how can we get a certified copy of the passport? I am not sure there is such a thing in the middle east (Syria). Does it mean we photocopy the passport and have them stamp it? not sure we can do that. did you do something like that in Egypt?

I was wondering if we photo copy the passport and then go to the American embassy to notarize it, does it work like that? I would like to include my wife, but she does not have a SSN or ITIN since the case just got to NVC

thanks

I had my husband send over his passport via a friend traveling to USA, and the W7 I filled in and he signed along with the singed tax return, I sent this all off to ITIN operations in Texas, on 2/8 I sent a letter stating that once verified I needed his passport sent back to me so I can take it back to Egypt...I just got it back in the mail today.

the certified copy must come from the issuing agency, so for my case only the Issuing agent IE Egyptian government can make the photo copy and then he would have had to go around collecting stamps.  This seemed for of a headache so I just sent down the original passport as it is the only stand alone document...there is a list of others that can be used, a certified copy of birth certificate, and translation stamped, if that is what your country does with certified documents.
