helllo,

 

I was wondering if anyone could help with this. im trying to file my I 751. if you entered the marriage in good faith but went thru abuse, and unfortunately dont have much evidence for it besides photos of bruises, personal statement and affidativ of friend and videos but since you cant submit that i guess it doesnt matter. never called cops, was too afraid. i am officially divorced so I can check the box that good faith marriage but ended with divorce. or check bot boxes. with the battered spouse box. I am just concerned because I have missing evidences as we were living in friends house so no joint lease, no joint bills, nothing like that. no health insurance together. I have photos, wedding, engagement, with family, plenty. and bank statement. joint account. also life insurance, me stated as beneficiary. pretty much thats it. should I check both boxes and send in the good faith evidences but since i have missing ones i explain why i dont have it and that i cant get them because I cant contact him or his family cause our marriegde ended with me escaping from abuse. and send the photos on injuries etc. or just check the divorce box and  say that i cant attach certain document due to me not being able to get them since the marriage ended not on good terms? thank you for any help. greatly appreciated

Even if you tick the abuse box you still have to prove it was a bonifide marriage. 

 

Can the friends whose house you stayed in write a letter attesting to that in an affidavit?

it was him family. and no unfortunately not. no one has been contactd for over a year it was an awful ending to the marriage i was scared every day he d find me I dont want to trigger anything, i cant contact im glad enough i got out of there. :(

Yes you are right being safe is the most important thing.

 

If you had health insurance that you have letters for that have the same address as other evidence that might help. 

 

They only want want to see things post marriage so anything to do with engagement won’t count.

we didnt have health insurance unfortunately. should i explain why i dont have these evidences and then maybe they will understand why i check the battered spose box as well since i ll be attaching some evidences for that too. i dont have a full list of evidences for both cases but a limited amount from both of the lists that they want for each X ed boxes, as proof.

Advice I have seen on here has been that even if you tick battered spouse you still have to prove bonifide marriage so effectively you are putting two sets of criteria on yourself instead of one. 

 

@sandranjhas given lots of advice on vawa and battered spouse applications hopefully she can take a look and advise?
