What’s the inadmissability? This may help get more specific responses as there’s a huge difference between, say, certain types of crimes versus having been deported.

At my husband's visa interview last week he was told his deportations were able to be ,"Pardoned". But, because he stated, "yes", during a checkpoint in whether he was a US citizen, he is Inadmissable.

 

Yet, I looked up USCIS website, and it reads certain articles where you can file for a I212.

 

So, now we feel stuck, and unsuccessful.

 

His deportations were all due to him wanting to be with his two sons (that he had from a previous relationship).

Thanks for the clarity.

 

So was he refused solely due to the past deportations, or was it due to having claimed to be a US citizen? The former can be waived, and a good case has a good chance  for being so IMO. The latter (claim to be a USC) is not waivable.

Was he offered a waiver? False claim to citizenship has no waiver.

Then unfortunately, there’s no waiver possible (at least under current law). An I-212 would not apply here.

There is no waiver for his situation (claiming to be USC when one isn't, is taken extremely seriously).

If he were to "try", he would be denied based on the above.
