I hope so we get to March, but the possibilities are few, and for the time they're taking.. And regarding the interview schedule, representatives of NVC say that even RD has not sent the calendar of available appointments and therefore haven't yet been able to schedule interviews for those who already have our CC.. It'ss sad to know, as I have seen RD people with CC from Dec who got their appointment date in 1 or 2 weeks, but now they have been delayed more... This is my second week since I had my CC and I am still waiting for the date of my interview... I don't see the moment when all this is over and I can be with my wife!

What is your SD?

sure so when filing i had three options...

1. married filing jointly (need ITIN and financially speaking best choice)

2. married filing separate with exemption for spouse (need itin and not as good financially speaking as jointly)

3. married filing separate without exemption for spouse (DONT NEED ITIN and worst financial decision).

I didnt want to deal with headache to get itin which can be a bit complicated because it required notaries and original stuff, i did option three. i had to pay money instead of receiving money and was worst financial decision out of the three. BUT, once my spouse is here and has ssn, i can amend it to jointly and get all the money back i shoudve in the first place.  so in the long run option 3 is best for me because less headache now and loose some money but get it back 4-5 months later.

i didnt want to use last years because my financial situation better this year, and i think there was one mistake on last years taxes and didnt want it to cause issue, and having ur spouse on ur taxes i think makes ur case stronger and show them its not fraud so that helps too i think.

Ok thank you. we now have to decide.  Do you know if your spouse will have to keep the ITIN when she's there or does she get a SSN?

Question...

What is the process time difference between a citizen and a resident petition? I'm a citizen and it's been 10 months since I started this process for my wife and I'm waiting for my case number at NVC. Now, my friend who's a US resident started April 2016 and he is apparently finished with NVC and has been waiting for 3 months to get an interview. Has it taken that long because he is a resident? Do citizens get an interview date faster?

My friend is married to a resident and she took 18 months. I'm married to a citizen and everything is moving faster than her and now it's been 7 months and I heard that it will take maximum 1 year time for a citizen. All the best for you and your family.

My SD is 2/2. They told me that it was sent to the review process and could take 11 weeks,  but from the group feedback some CCs are 4-8 weeks. I am hoping to have an interview date in April. You know what's funny? We've wait almost a year for this entire process and the interview is like 5 minutes. We just need to hang in there a bit longer, everything is worth it. Good luck.

So for option 3, a tax specialist told me that I cannot amend from Married filing separately into married filing joint! She told me that I can amend it if it is the other way around. Are you sure we can amend from married filing separately into married filing jointly?

Thanks

I went to H&B tax office. Needless to day, she did not seem to be a real specialist :) I kind of knew things she did not know. Well, your post made me feel better man, that I can some money back.

She even told me that in order to get ITIN, my wife has to have lived in the US for 3 months!!!!, which I think is not true!

Thanks

i think u have it other way around.... i found below on turbo tax site...

Step 4—Amending your tax returns

The IRS allows you to change your filing status for a tax return you’ve already filed if no more than three years have passed since the original tax filing deadline. For example, if you filed as a single taxpayer last year, but now realize you qualified for head of household, you need to make the change on an IRS Form 1040X.

When you change this status, you not only obtain a larger standard deduction, but your income for that year is subject to lower tax rates. Making this change will likely result in a tax refund, but you cannot receive it until you file the amended return.

You can amend a return to change from married filling separate to married filing joint but not from married filing joint to married filing separate. So, once you file a joint return you can not change it to a separate return.

Hi, guys.

I have question, our I-130 for IR got approved on January 5, sent to NVC January 17, NVC received on January 24, but yet NVC can’t issue case number still.

They sent our case to supervisor 2 weeks ago, still nothing. Operators saying there is no problem with our case, they just have too much work right now, but it seems to just usual way to answer.

If here is anyone with similar dates let me know about your progress pls.

We are very nervous over this situation, because we were for 2 months behind processing time in USCIS nobody were giving , up until we ask congressman to help, and then they approved us in 3 days.

Espero tener una entrevista en abril. ¿Sabes qué es gracioso? Hemos esperado casi un año durante todo este proceso y la entrevista es de 5 minutos. Solo tenemos que esperar un poco más, todo vale la pena. Buena suerte.
