Hi fellow members,

I am a conditional permanent resident (CPR) card holder. I got my CPR card in June 2006. Due to some personal family reasons I am planning to go to my home country next month. Due to some personal resposibilities I need to attend to while I am there, I am not sure how long I will have to stay overseas. There is a very likely chance that my overseas stay will be for more than 6 months. My CPR status will be expiring in June 2008. I will be definitely returning to the US by April/May 2008 and file I-751 along with my husband to remove conditional status.

Do I need to apply for a re-entry permit? I looked at the instructions for I-131 form and it says

"If you are in the US as a permanent resident or conditional permanent resident, you may apply for a reentry permit. If you stay outside the US for less than one year, you are not required to apply for a reentry permit. You may reenter the US on your permanent resident card (Form I-551)".

Has anyone been in my situation? Please help! :help:

If you are planning to leave in May 2007 and you will be returning no later than May 2008 what you have quoted indicates you do NOT need a re-entry permit. That said, since plans can change and you just never know, it seems like it would be a very smart move to apply for one before you leave, but it may not arrive before you plan to go.

When are you going to leave? And return? If you leave May 2007 & returning in May 2008, you maybe cutting it close.

I will be leaving in July 2007 and plan on returning in April 2008. There is a possibility that my return could be delayed till May 2008 but in any case no later than May 2008. (My CPR expires in June 2008 so I don't want to risk it by returnig in the last minute).

Do I Need to Be Physically Present in the United States at the Time of Filing?

The Form I-751 (Petition to Remove the Conditions on Residence) can be filed regardless of whether you are physically present in the United States at the time that you file. However you must return to the United States with your spouse and your children in order to comply with the interview requirement.

A.Departure from the United States before a decision is made on an application for a reentry permit does not affect the application.

You must be physically present in the United States when you file the application. However, a reentry permit may be sent to a U.S. embassy or consulate or department of Homeland Security (DHS) office abroad for you to pick up, if you request it when you file your application.

If you stay outside the United States for less than one year, you are not required to apply for a reentry permit.You may reenter the United States on your permanent resident Card (Form I-551).

If you intend to apply in the future for naturalization,absences from the United States for one year or more will generally break the continuity of your required continuous residence in the United States. If you intend to remain outside the United States for one year or more, you should file a Form N-470, Application to preserve Residence for Naturalization Purposes. For further information, contact your local USCIS office.
