Timeline

I need some advice fellow May filers:

My husband and I mailed out his paperwork for his AOS and EAD in the beginning of May. He just had his biometrics done yesterday - things seem to be running smoothly so far. We did not apply for the AP because we're just planning on traveling in December. I was hoping he'd have his green card by then.

However, I'm realizing now that it is quite possible that he won't. And on top of that, we'll want to buy our tickets probably in September (for good rates).

Should we wait a few months to see if we have an interview or if he gets his green card and if not, then apply for AP?

Advice from anyone who has been in this situation would be great.

It seems that the AP takes a few months to be approved, correct?

I'd appreciate any help - thanks in advance.

Congrats, Mephys!! :dance: Hmm, since we filed on the same day, and both had our cheques cashed on the same day... perhaps I can look forward to an NOA date of May 30th, too - hopefully the m-i-l will call tonight with some 'news'!

Hmm, I didn't have any luck trying the cunning trick with the receipt numbers - I guess mine just haven't gone into the system yet. Not that I'm getting hideously impatient or anything, oh no, not me... :whistle:

So we will be twins for a while :)

Hi Bora Bora,

I am not in a similar situation as you, but I want to say what I would do in your case.

If you are lucky, you can get your GC by end of september, you can make your travel arrangements and find cheaper ticket etc.. But as you said, there is big possibility, your GC will arrive after September. I dont know where you are planning to go, but I would say you have to pay between 100-200 $ more per person if you buy your ticket in October or November. By applying for AP which costs $170 now, you will not need to worry about GC anymore.. Basically you need choose between:

1- a-apply for AP now, 170$

b- buy your ticket in September, X$, 2 PEOPLE 2X$

c- have a care-free vacation

TOTAL COST= 2X+170

OR

2- a-wait for GC, not pay for AP, 0$

b- buy an expensive ticket later, pay (X+ Y)$, 2 PEOPLE 2(X+Y)$

c-worry about GC and tickets until you get them.

TOTAL COST= 2(X+Y)$

Now the question is whether 2(X+Y) > 2X+170, in other words whether Y> 85 or not?? If you think that increase in per ticket will be less than 85$, dont apply for AP.

If I were you, I would apply and minimize the risks, and not worry about anything..

I am not in a similar situation as you, but I want to say what I would do in your case.

Great reasoning though, I would probably apply for AP if you don't hear anything on your case by July. That's what I'm doing, but for EAD....I want to beat the fee increase if there's no movement on my case!

I had my biometrics done last Wednesday, but I missed my 11am appointment. I called the USCIS and then they said every Wednesdays they accept walk-ins in every center. I just went at 2pm, th screening officer was likeoh why are you late, and then myhusband told him we called USCIS and they said it's ok to go even we missed the appointment.

Just want to let you guys know that you can still have the bio done even if you missed your sched..EVERY WEDNESDAY THEY ACCEPT WALK-INS.

I'll have to talk to my husband about this - maybe we'll put off the trip all together.

But if not, I think it's a better idea to send off for the AP before the fee increase too.

We mailed off the EAD knowing that the GC usually takes longer.

I agree BUT the new fee for I-131 (AP) will be $305 (fees change on July 2007). So you need to hurry if you want the option #1...

Since with the new fees the AP will be technically free with AOS application along with EAD, what if I filed only for AOS and EAD, will AP still cost me something since I already applied for the 2 others?

Im confused about that

So I talked to my husband about it and he said we wouldn't go to Brazil in December. We can always go later and he doesn't think we need to spend the money.

We paid the extra for the EAD to CYA - and we both think it's worth it. But the AP is not as necessary.

Hello guys! My checks have been cashed last May 31st but I still didn't receive any letters from the USCIS until now.. I noticed that most of you have received the NOA1 then the checks cashed after that. I dunno, I am just worried coz I am expecting an RFE for my A# and they cashed my check.. Does that mean that I am not on RFE???

I still can't tell if I am a May filer even if my checks are cashed in the last day of May since I have no letter yet stating when they took action on my case...

Wait some more, your NOA1 will be on its way very soon.. RFEs can be sent after biometrics or CSC transfers even so there is no really a pattern, it usually happens upon the discretion of the person(s) reviewing your case, so don't worry too much for now. I got my NOA1 after the checks were cashed in of course, and received it in the mail 8 days after they received my AOS application.

No NOAs for us either, and my cheques were cashed on May 31st too (didn't show on my account 'til yesterday, but it shows that they were cashed on May 31st)... hopefully on Monday we'll both get something!

Oh, my (possible) receipt numbers from the backs of the cheques are still not bringing up anything on the USCIS site, either. Oh well...

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

OMG FeatherB I was thinking the same. Totally dejavu again with I-129f.

Having our SO's (L) here with us makes this wait far more bearable than the I-129 F! :thumbs:

Yup!! I can see that if someone needs to be able to work ASAP, it might be pretty nerve-wracking, but still nothing compared to what felt like an endless wait at the time (even though ours wasn't THAT bad at all, especially with hindsight!!) :)
