I was arrested 23 years ago for theft. I was placed in a pre-trial diversion program.

After completion of the program the case was dismissed and there was no conviction .

Since this is an offense that is not disqualifying, it this be a problem for me to get my fiancé 

over here.

You're probably good. They're most concerned with the beneficiary's criminal record, that is, your fiance's record.

So I am understanding that they are more concerned about my fiancé record than mine....I just have to be out front and report it...

My fiancé already knows about this stupid mistake that I made

You should be fine. It was a long time ago, the case was dismissed, and you're not a repeat offender. Definitely be honest about it if you're asked,  but I wouldn't worry.

Shouldn't be a problem

 

I have seen some Immigration officer at POE try to give the fiancé a hard time regarding a petitioner criminal past history, but hopefully they won't bother your fiancé.

Just when you think you have TDS eradicate,  a new case shows up.
