Absolutely.  There is no USCIS waiver or wiggle room as far as multi marriages are concerned......this will end badly for her...

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Jason from Philippines is currently working in the US as H1B. Still single and currently processing for green card with the help of employer.

 

Carla is married (civil wedding) with 3 kids in the Philippines but husband is already with the new GF and just had a baby. They are currently on the process of getting annulment and Carla's husband seems to be cooperative so far.

 

Question: Can Carla go to the US and get marry with Jason (working as H1B) while annulment in the Philippines is still pending? Will this cause any issue while processing the green card and adding Carla as spouse H4?

NO.  For two different reasons.    The obvious that everyone jumped all over - Carla is still married.  

 

The other applies AFTER the annulment is finalized.   To get married in the USA means a K-1 Fiancee visa, this can only be petitioned by a USC, which Jason is not.

 

But if Jason does get his green card, and Carlo does get her annulment .. they can get married in the Philippines and as a green card holder Jason can petition for his spouse.

 

So there is a glimmer of light at the end of the tunnel .. but annulment is a l-o-n-g tunnel.

Its not common but there is an issue because there is no divorce unless your Muslim. So a average couple gets marries but then seperates and moves to seperate provinces and finds new loves with other people. But they cant get an annulment because it costs $5k and 2 years at least.

seems a very common issue on vj.
