Marrying in the US (asking from a friend)

Hello.... I would like to get any advise if possible.


Jason from Philippines is currently working in the US as H1B. Still single and currently processing for green card with the help of employer.

 

Carla is married (civil wedding) with 3 kids in the Philippines but husband is already with the new GF and just had a baby. They are currently on the process of getting annulment and Carla's husband seems to be cooperative so far.

 

Question: Can Carla go to the US and get marry with Jason (working as H1B) while annulment in the Philippines is still pending? Will this cause any issue while processing the green card and adding Carla as spouse H4?

 

any input is highly appreciated.

No.  She can not marry Jason legally while the annulment is pending.  Dissolution of her previous marriage must be complete before she can legally marry in the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I did not think bigamy was allowed in PI, certainly not in the US.

 

Intrigued, has Carla a visa to visit the Us?

One other thing, it is actually ok to ask for self, although 'asking for a friend' is ok too.

 

The slight problem with 'asking for a friend' is that it is overused and has become as transparent as an untinted car window glass.

Then the marriage is illegal and any immigration action will be revoked once it is discovered in the US.....and I have heard that is an extremely serious issue in PI.

 

This will end very badly for the couple.

my suggestion to Jason is to get legal counsel from attorney not in public forum.

Jason doesn't need an attorney.  He just needs to wait until Carla is not married.

Are polygyny and polyandry common in the Philippines? Long essay short: she will actually face a prison term and as sure as she has a nose lose her Greencard (if she is in that stage), or possibly have her citizenship (if she has already got there) revoked and then deported to her husband in the Philippines if someone ever outs her to the feds. Take that to the Federal Reserve Bank, it is legit money.
