Hello,

I have a question about proof of domicile to present some documents during NVC stage soon after approval with USCIS. Let me explain that I have been living in the Philippines for 7 years now, receiving SS disability, and filed I-130 in the States during my vacation which I should have filed via DCF instead. A huge mistake I made so anyways I have documents to prove would be driver license and banks with US address if that would be enough?? Do I need the statements that is showing the amount of money spent, etc? I do got a place intend to live and have USC sons via CRBA  to enroll them for school. Help would be appreciated! Truly yours :)

I am presuming you are the US citizen petitioning your spouse? You mention you are receiving social security disability. Is this from the US? One of the stipulations of the I-864 is you must be able to financially support your spouse (total household) above the poverty line. Otherwise you will have to get a joint sponsor who meets the requirements and lives in the US.

Generally domicile is providing proof you will return to the US and live there. It is showing proof you have a place to live (e.g. lease agreement, house ownership, agreement with person you will live with). I am confused on having a driver's license as you have been gone for 7 years. How can you have a US driver's license if you don't live there?

I'm sponsoring for my spouse and have above the poverty line except to show the proof of domicile with my question. I have been to the States almost every year and renew my driver license expiring in 2022, manages my banks/credit cards with US. I do have an address intend to live and plan to enroll my US citizen boys ages 6 and 5 via CRBA to school.

It sounds like you have a lot covered. With my spouse I wrote a letter during the NVC stage and outlined which steps exactly he had taken to re-establish domicile.
