I had my SSN back in school when I worked in cafeteria.. Since then I've been working so it wasn't an issue for me. But I do remember you need to have valid work authorization in order to apply for SSN card. On the card it will say "VALID FOR WORK ONLY BLABLA" because you aren't USC or LPR, that's it. Even with H1b or L1 we still get that line on the card. Only when you become LPR or USC that you can remove it.

And the reason why you could still use your present marital status to apply for one if possible

But it’s up to you to figure out what’s best for you.:)

I've been wondering about this too! He can only file as either married filing jointly, or married filing separately. I thought the ITIN route is the way to go, but since you got that info from the SS office, Ill try that too! Thank you!

Arg!  I didn't realise that I may need a SSN for my husband to put me on his taxes this year.  I am going to do some research on this now too.  @Nikolet Kamenov - please give us updates on whether this is successful.  Also, please let us know what the update is on your case!

I have been trying to call USCIS in order to clarify some details on the RFIE before we return the documents to them.  I had no idea that this process wasn't straight forward.  I called them yesterday at 3pm and after being read a whole bunch of (irrelevant) script, the advisor stated I would need to speak to level 2.  The advisor wasn't very customer friendly, however, wasn't rude, rather more robotic.  They informed me that they couldn't transfer me to "level 2" and I would have to call back the next day.  Apparently there is a quota of how many calls they can transfer in a day and it had hit the limit.  I called again this morning and spoke to a friendly advisor who transferred my call.  I then heard an automated message that said all their advisors were busy and my call would be returned in approximately 800 minutes!  I am still waiting for the callback as it has been nowhere near that amount of time yet.  Confusing, as I am sure the lines won't even still be open by then.  Has anyone else experienced calling USCIS?

I heard they are accurate in estimating call back time. So just sit tight and wait for the call.

So sorry you had to wait this long!

Same as @Rmsean i got a notification but nothing changed. That also happened when they sent me my Biometrics appointment. Im thinking maybe ive been cleared with Biometrics or they sent some kind of a letter. No idea...

As far as filing Taxes i will wait for whatever that is so if its a letter or hopefully some kind of a card from USCIS it should be delivered within one week. If i dont get anything by Wednesday i will go to Social Security office and find out if i can get some kind of a number so i can get my taxes filed with my husband.

The Story:

I tried to file my husbands taxes online through Credit Karma however it gives you 2 options as married and that is file married jointly or file married separately. Either or option requires you to fill out a SSN for your spouse or dependent. I than went to H&R Block to find out if maybe im not doing something right and if there is another way... well... there is no other way. Only way to file married is to have a social number or a ITIN number. After searching the web the ITIN number could help out but only IF you dont have a ssn you are not eligible for one and you have not applied for one... well that is not an option anymore.

Being desperate i decided to call USCIS because maybe they would know since i am waiting on them to get EAD... the officer instructed me to call Social security and find out if there is any way i can get a number to file taxes like a limited time SSN only valid for the IRS. Also she said if that does not work to have him file as Single. (So if the immigration officers ask me i can say i was instructed to file Single by their people)

So.... I called the SSN peeps and they told me to go to a local office with my Passport (Valid), my marriage licence and my NOA's so they can see that i am pending status. She also said to bring some proof that i am required a SSN to file but i told her i cant really get that since everything is online... she said thats fine just go with that explain what you explained to me and see if they can do anything.

It really sounds like this is not the first time they run into this issue so they have a way out... the stupid thing is that they are not telling you what exactly you should do, rather they are making me go crazy calling people and going to places...

Anyway thats my story... Ill keep you updated

I think you both can deposit the Tax forms with an ITIN request form at an IRS office. Technically, you are still able to apply for an ITIN, until you receive tour EAD, because the instruction say:

Quote

Don’t complete Form W-7 if you have an SSN or if you’re eligible to get an SSN. You’re eligible for an SSN if you’re a U.S. citizen or if you have been admitted by the United States for permanent residence or U.S. employment.

After you get your EAD with SSN, you can amend the tax return, and not use the ITIN again. It expires automatically if not used. Still, you would also have to notify IRS with a copy of the ITIN letter, as they specify. Anyway, SSA and IRS are two different government agencies, and one request isn't likely to harm the other.

Yea we were thinking of that too, but they want you to calculate your taxes as much as you can, and pre pay the taxes. Than if they think that its necessary they will give you a six month extension
