Timeline

Guys... because we have all filed around the same time and most of us are without socials i have questions for IRS tax filing

Your spouses need to file 2017 tax return by April 15th right? So how would you file since you cant file as married without a Social number but if you file single you look like your marriage is not bona fide?

I am in this dilemma because we cant file any taxes right now and i dont know if i will get my SSN on time and we might pass the DUE date for filing and we will get fined.

Go to the nearest social security Administration Center and apply for an SSN just with your passport, I-94 or the NOA1 Letters. They will give you a conditional number which is only valid with an EAD. You’re entitled to have one now if you’re a K1 applicant .

u can apply ur SSn and bring ur original marriage certificate, passport n I-94.

Or you can get an ITIN number.

I think you can still get yourself a conditional SSN with your NOA1 Letters. I suggest you go and try

I'm not sure if you are eligible to apply for SSN right now since USCIS haven't grant you the work authorization (unless you entered as K1). Therefore, I think your SSN application is not even considered as "pending"...

I dont know... i remember when i was filing i checked that i allow them to issue me a SSN number

Well my husband have a guy that make his taxes and he knows our situation but I believe that he is going to fil like married but just he :ph34r: I also came here whit a visitor visa and if in the interview they ask we going to say that is because I didnt have SSN by the taxes time... How your husband made his taxes before??

They will issue SSN ONLY if you are authorized to work. So the basis you have pending SSN would be EAD was approved for you. Since we haven't gotten to that stage, I think getting ITIN doesn't hurt. And you can file the ITIN application along with tax return filed. 

 

Just my suggestion here. Not sure SSA recognizes NOA1 as proof for working eligibility.

He applied as Single. He can still apply as Single but i think that doesnt look too good that you are separated on your taxes, that is one proof of bona fide marriage i think

Well, the SSA doesn’t issue an unconditional SSN to K1 holders unless with a GC. So be it visitor or a K1 holder, we’ll still be issued a conditional SSN that clearly states that, “VALID FOR WORK ONLY WITH DHS AUTHORISATION.” If you did not check the section about SSN which allows DHS to issue you one while filling your Form I-765 EAD, then please go to the SSA and try your luck.

Yes well he is going to does his taxes as married and house head or something like that, I asked last night and he told me that his account guys knows our situation and he will take care of that and also his taxes will take more time this year... Sooo probably I will send an email to the account this weekend to know exactly how he is going to do it... Right now we are dealing that maybe my husband loose his job tomorrow because the owners are selling the bussines and he is a contractor sooo he and more people there are the first on the line :wacko:

I had my SSN back in school when I worked in cafeteria.. Since then I've been working so it wasn't an issue for me. But I do remember you need to have valid work authorization in order to apply for SSN card. On the card it will say "VALID FOR WORK ONLY BLABLA" because you aren't USC or LPR, that's it. Even with H1b or L1 we still get that line on the card. Only when you become LPR or USC that you can remove it.
