This message is to anyone who has filled out a W-7 form for an ITIN.

 

Am I (the US citizen) supposed to fill this form out for my husband? (He lives in Morocco.)

Or am I supposed to have my husband fill this out in Morocco and mail it from Morocco?

 

Please heeeeelp me :D

We are currently completing this form . Same situation as you. My husband is completing the form and then I (USC) am sending it in along with our taxes.

You, the taxpayer fill out this form and submit the  required documents to evidence the marriage

you are claiming your spouse

 

not hard to do it for 2010 taxes

this is important to do for Morocco as they expect you to show commingling of assests when married / other countries don't go thru this

Last year, I went to an "international" tax guy. He told me NOT to file for an ITI because then I would have to pay taxes on my hubby's income. I think it would become very complicated since my husband has two of his own businesses, but not tons of income.

 

Any thoughts?

Maybe...  maybe not.  With the foreign income exclusions and credits your lower overall tax rate maybe less because of the filing status.  It is difficult to say unless you prepare it both ways and then decide based on the overall lower tax liability

If he's self-employed, can I just attach the tax papers he does in Pakistan without doing all that stuff for the self-employed and put his total income down?  OMG, it doesn't match what we do. It's so complicated. They have already done deductions, etc., on his documents, but it makes no sense to me, even in English.

Piggybacking on this topic, my wife has her SSN and we are filing jointly, however, my stepdaughter doesn't have a SSN yet and can't until her EAD goes through.  We are in the AOS process from a K-1, K-2.  Besides the W-7, are there any pitfalls I should be aware of?  What documentation should I send with the W-7 for the child?  How will this affect state taxes as well?  Thanks for reading.

To apply by mail requires mailing the actual passport (not photocopy) as proof of identity along with the tax return to Austin, Texas. They process the ITIN, attach the number to the tax return, send the passport back, then process the return.  Or see the other ways to have the passport verified by a tax office on the IRS WEBSITE https://www.irs.gov/individuals/how-do-i-apply-for-an-itin
