I-134 Previous Affidavit of Support

Timeline

My petitioner submitted an I-864 back in 2000 with his previous marriage to a Polish woman. She became a US citizen circa 2005, and then she left the country permanently when they separated in 2006, with their divorce taking place in 2009.

 

1) Given that he is no longer financially responsible for his ex-wife under any circumstances, does this nearly 18-year old previously submitted affidavit of support still need to be noted in the I-134 we are submitting now?

 

2) If yes, should we explain that she became a citizen and then permanently left the country in the Additional Notes section of the affidavit? 

 

His income is more than sufficient to provide support to her and myself even if she were still dependent, which she is not.  We are not sure whether any such explanations are required or even advisable, given that we don't know how to prove that she left the country and can't easily provide her A number if asked.

This was my case, I did a 134 form for my ex when I did a k1 with her, we were married 12 years when we got divorced. The and I will do another 134 form with my current fiancé and K1, when I did the petition I marked "yes" (cant lie!!) and my lawyer said as long as the first form was 10yrs or longer than it don't matter your current 134 form, but you have to state yes and how long ago on the petition that was sent in for 129f

August 4 2017 - I-129F Sent to USCIS

August 7 2017 I-129F Delivered

August 9 2017 NOA1 Sent out

August 14 2017 - Received email from Lawyer NOA1 received

August 28 2017 - Returned to USA/NOA1 was in the mail waiting for me delivered on August 14th according to my brother who collected my mail

September 7 2017 - 1 month into waiting for NOA2

October 7 2017 - 2 months into waiting for NOA2

November 7th 2017 - 3 months into waiting for NOA2

December 7th 2017 - 4 months into waiting for NOA2

January 7th 2018 - 5 months into waiting for NOA2

February 7th 2018 - 6 months into waiting for NOA2

February 17th 2018 - NOA2 - APPROVED!! noa1-noa2 194 days

February 20 2108 - NOA2 Mailed

February 24 2018 - NOA2 Received

March 5th 2018 - NVC Received Case

March 7th 2018 - NVC Case number received.

March 7th 2018 - DS-160 Submitted online

March 17th 2018 - Case sent to embassy

March 18th 2018 - Case Arrived embassy NVC says "Ready"

March 23 2018 - Medical exam completed

April 30 2018 - Interview - 221g - Administrative processing

December 12 2018 - Email from embassy Administrative processing completed request to send passport, new 221g , new medical

December 24 2018 - New medical exam

January 9 2019 - Medical ready for pickup, sent passport to embassy

January 10 2019 - Passport received by embassy.....case update as well

January 11 2019 - CEAC page shows visa status ISSUED!

January 14 2019 - Visa received.

January 15 2019 - POE - Dallas Ft Worth - Arrived Mobile Al airport - now home with me.

Right, of course there's no point in lying since the USCIS already knows about prior foreign spouses in any case. :P Rather, we're trying to understand whether it would fall under "not applicable" since it's an affidavit about current, existent financial obligations, not non-existent or no-longer-existent obligations. 

 

Okay, awesome! So we'll just fill in the info and skip the explanation if ten years is the cut-off anyway.

Just fill in the information as requested and also he can include a letter stating when his exwife became a US citizen.  It doesnt matter where she lives after that point so i wouldn't bother with the "she left the country" stuff. 

Beyond that the I-134 isnt legally binding anyhow.

So, if it's better to enumerate all details whether they are relevant to our current situation or not, I have another question then: 

 

I have adult children who have been living independently for years, who won't be joining us, er... obviously. :P Therefore we've marked that section "not applicable". Should we instead be listing them and then adding an explanation about them as well? When we listed them on the I-129F, it was simply as part of the biographical data as directed, since it was apparent from their birthdates that they are too old to join us, not that they'd want to anyway.

 

But with the I-134, perhaps I'm a bit confused about the purpose of this form, because I keep thinking it's only to supply information about current, existing financial obligations. I thought the direction to use "not applicable" was for any redundant or inapplicable information including family members or ex-family members who haven't any, and will never have, any affect or relevance to our financial situation.

 

I hope my questions don't sound argumentative!  I'm just sincerely trying to understand what is being asked of us so that we can properly complete the form.
