Hello,

Please help! I am a US Citizen but my parents are here with out a status, they came in 1991 illegally when I was 3 years old. I obtained a visa through marriage and are now a Citizen ready to file for my parents. Can I? Has anyone been through this process?

TIA!

As they entered illegally they cannot adjust status in country. They must leave, which will trigger a ban. Once the ban is up, and assuming the IR-5 visa still exists, you can petition for them.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!

Filed: Citizen (apr) Country: Argentina

as said, not for parents who entered illegally in the country

they would have to leave and be 10 years out of the country, there is no waiver for parents, and then you would be able to file for them,

that is, if the category still exists by then

There are options.  I would highly recommend you meet with an immigration attorney instead of seeking advice online because cases like your parents can get complicated, but there are options depending on how your parents entered.

If you didn't have to leave to adjust your status, it's likely your parents don't have to either. Find an immigration attorney.
