Tourist visa for permanent resident children

Hello!

My husband is permanent resident and he would like to petition for tourist visa for his children, so they can come here in the US to visit him.

Are there any restriction for that? I am thinking this because maybe at the consulate they can think that the children want to live here, but they just want to visit his dad here.

You can not sponsor someone on a tourist visa.

but he does not want to sponsor them yet. He was just wondering if they can apply for a tourist visa even if he is a permanent resident.

You stated he wanted to petition for them to get a tourist visa - londonergirl was just pointing out that there is no petitioning or sponsoring people for tourist visas.

 

They can apply but the embassy are required to assume that the children want to immigrate. Parents can fill in the online application for minor children and your husband can tell the children that he will pay for the cost of it but that’s it.

 

They have to show why they are required to return to their own country, school enrollment, mothers statement showing that they are permitted to visit but not stay. 

 

Its a a long shot but if they have the means to pay for the interview.

No worries, does he have a joint custody agreement? If he does and it stipulates the children must live with the mother but can visit the father that might help.

In the divorce sentence is stated that the children must live with the mother and he can visit them anytime.

so probably this can help

Hmm if it says specifically he can visit them not that he has visitation or they can  visit him it might be a bit of a harder sell. 

 

I would suggest trying and if it doesn’t work getting the custody agreement changed to state the children can visit him in the us but only for certain weeks of the year.
