RFE Complicated things a bit.

Hi all,

 

I have received an RFE which requests evidence to establish the beneficiary fiancee's true date of birth.

 

I did not know this prior to now, but originally my fiancee had a different name.  Her birth certificate lists the original name, not the current name.  Her passport lists the current name only.  We've been together for 7 years while I was living in Taiwan, and her name was apparently changed back when she was just a tiny child due to bad feng shuei of the stroke order of the original name (yes, really). 

In our time together, this has just never come up.  I never call her by her Chinese name anyways, and under i-129f section 10, I listed other names as her English name, which everyone calls her.  To my knowledge at the time, that was complete.

 

So, here's my conundrum.  The I-797e invites me to send birth certificate or passport.

 

1)  If I send a copy of her passport, then it probably satisfies the problem of establishing true date of birth.   But, I'm guessing someone is going to ask to see her birth certificate eventually at some point in time anyways.  Also, I'm in the uncomfortable legal position that I am required to provide as accurate of information for these applications as possible.  So, is it possible to append further information to my original i-129f, question 10?  How and when should I do this?


2)  Procedurally, if I send a copy of a passport, should it just be open to the main shiny page with photo and bio date, or do I like need to copy each and every page or what?  Black and white copies are also okay?

 

3)  Anyone ever had a similar situation as mine?  What did you do?

I'm going to answer my own question:

 

According to the immigration lawyer I spoke with, there's not really a way to "amend" an i-129f.  She suggested that I answer the RFE in the terms that it asked for, to resolve the issue of true date of birth.  Later on, once it's approved, I can make additions electronically if needs be.

 

But basically JUST ANSWER THE QUESTION THEY ASKED.

 

ALSO, they give enough time to collect what they need.  So take your time and answer the question.

 

Also, when sending a copy of a passport, only the bio page is needed.
