Hi guys,

 

I came home to France to spend Christmas with them and for medical reasons , i was supposed to go back to the US the beginning of january but i got sick and couldnt hop on a plane. still recovering and my card expires in a few weeks... should i just mail the package off from here, of course putting my us address on the forms or risking getting back there very last minute? i m also filing the i 912 the filing fee waiver. in case of denial is it ok if i attach it and re mail it so they know originally i didnt file it late? in case if denial it goes back to the address thats on the form right? please help if anyone have any suggestions or experiences. thank you so much.

Yes, you can mail the I-751 from anywhere - as long as you clearly reside (ie your address is) in the US.

 

Presumably you'll have time to return before your card actually expires, since you might not get readmitted to the US without a valid green card. The NOA (which acts as your extension) will, of course, be sent to your US address.

okay awesome. so I dont have to write an explanation why it was sent from outside the US?   also if the extension will be sent to my US address and then mailed to me by my roommate is it ok like that? so then i can return and wait for my biometrics? thanks a lot for your comment.

I wouldn't bother... the person who takes it out of the envelope isn't the same person who will eventually process your application.

 

As far as your roommate mailing you your NOA - that plan should work, but you may be waiting outside the US far longer than you want... usually  the NOA comes within a couple of weeks (and then however long it takes to get to you) but  sometimes it takes a long time (or doesn't come at all. And then you're stuck outside of the US or you need a travel document from the consulate and you run the risk of endangering your status for real (if you're outside the US too long). 

 

It's up to you, but I wouldn't chance it. My advice is to send the I-751 asap from wherever you are, but then get on a flight back stateside before your green card expires.

oh okayy. if i go back im just gonnna mailthe pckage off from the us then i think. if at the airport they look at my passport and they see that its afew daysaway from expiring thats not a problem right?

Expiration date is an expiration date.  It's not a few days either side of it.

You need to get back to the USA before the expiration date on your Green Card.  Otherwise you risk not being able to get back!!!
