Hi all

 

So basically I lost my wallet, which had my green card in it. I need a new one, but trying to figure out if I can wait it out until I need to renew and remove the conditions rather than get a new one for $600 then pay the $600 again to file the i75i! It's just so much money!

 

My green card 2 year conditional expires 28th Sep 2018. However, I plan to travel to the UK July 2018. Is there anyway that I can avoid buying a replacement green card to allow me to travel when I would need to pay again to remove conditions? Also, how long does it usually take from point of filing i75 to getting the new green card?

You have to include a copy of your conditional card front and back or a copy of the noa1 from the application for a replacement when applying for removal of conditions.

 

How long removal of conditions takes depends on the office you are applying to but it’s around six months to a year and a bit.

Yeah thats fine I have a copy of the conditional green card. I can't apply for the i75 until june 28th, so I won't have a new one in time to travel. Are there any other options for me?

Eventually, you will have to present the actual card to a USCIS officer, in the ROC process. I do not know if they accept 'lost' as a valid reason not to. Perhaps someone here on VJ who might have lost theirs and did not get a replacement when they came to that point (of presenting the actual card) will see this and chip in.

Correct!!

 

The only other option is a stamp in the passport, BUT they give this stamp only when they take your expired GC. I am speaking from own experience. My ROC dragged on and on and I needed a second extension after the original extension letter expired. So I went in on an infopass, they took away they expired GC, and stamped my passport. So, the earlier you apply for a replacement, the better.

 

If your ROC date comes and you proceed before you receive the replacement GC, you attach a copy of your NOA (for the replacement) to your ROC application.

 

In the meantime, purchase no travel tickets.

Ive had this same experience, however my ROC was due to be filed within days, yours is in 9 months, minus the 3 months.  My experience I went to the field office who told me they would not stamp my passport without applying for a replacement card, because I had already filed ROC by that time, I wrote a letter of complaint and ended up with the stamp, as it does say if you are filing ROC then don't apply for a replacement. Your problem is your are about 6 months away from that date and they will probably insist that you replace it.  

Removal of Conditions..  TICK TOCK, TICK TOCK

 

Time to reset the tick tock clock again.   Roll my eyes.

Hi there,

 

i strongly agree with H & T about the fact that carrying your green card at all times is an heresy.

As a Lawful Permanent Resident you carry your driver's licence and leave your green card in a safe place at home. I even know people that keep it in a safe at their bank. You very rarely need to show this document.

- When you come back from a trip abroad

- When starting a new job

- During the naturalization process

- When you release it after becoming a U.S Citizen.

 

I may be missing a few.

The point is that,  not keeping this card in a safe place has very painful consequences.

I have never carried my green card with me, I leave it at home with my passport. 

But, my friend said it's legally required to carry it?

I saw this on USCIS page. 

"A Permanent Resident Card (Green Card) is issued to all permanent residents as proof that they are authorized to live and work in the United States. If you are a permanent resident age 18 or older, you are required to have a valid Green Card in your possession at all times."

Don't know if this means you need to have it ON YOU all the time tho.

Not a lawyer (worked with a few though; what I’d call a character-building experience lol), but “in your possession” is not the same as e.g. ‘must have it on your person/must carry it with you at all times’. Having a State ID or Driver Licence ought to be enough to authorities at State level and below (police etc) that you are in lawful presence since in most States now you can’t get such without verified proof of lawful presence. Federal authorities on the other hand would almost certainly want to see the Green Card.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
