Hi there, I'm new to this forum so please excuse me if i'm not doing this correctly.

 

2 years ago, while on a condition green card I noticed a mistake in the expiration date. It stated that my card expired one year earlier than it should. I sent the card off  with an i-90 to be corrected and 9 months later it was time to have my conditions removed! :o I hadn't heard anything from USCIS after attending a biometrics appointment regarding the card correction. I didn't have the card to send back with my i-751 because I had sent if off 9 months earlier but that hasn't caused a problem with my condition removal as of yet. I received a letter saying they are processing my case to have conditions removed and cannot correct the incorrect card because it was a conditional card. I had no idea they couldn't correct conditional cards.

The real issue here is that now I have the i-751 extension letter granting me the 1 year extension but no expired green card to accompany it. I believe this makes travel very hard, if not impossible. I haven't been back to the UK in a long time and am eager to see family. What steps should I take to get my old expired green card back so that I can travel this year. I sent of the i-751 in October 2017 so potentially have another 10 months when I cannot travel. 

I got myself in a bit of pickle, any suggestions?

Make an infopass appointment, they will stamp a temporary I-551 (Greencard) in a page inside your passport.

Infopass for a stamp.

I did exactly this with my most recent I-751 filing, when I received an extension letter but had a card that had expired 2.5 years prior.

 

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

@mrs.stinkleberry Did you get the I-551 stamp? And have you traveled with it and the letter?

 

My husband is in a similar position. His conditional GC had the wrong dates on it also...expiring 11 months sooner than his 2 yr aniversary of his AOS approval date. We filed his ROC based on those dates on got it returned with a letter explaining the mistake and instructions to file an I-90 and refile the ROC according to the correct date which was this Jun 2018. He also has not received the corrected GC but still has the old incorrectly dated card. We are not sure what would happen if he traveled with it and the extension letter, now of 18 months, because they might calculoate the 18 months from the date on the card, Jul 2017, rather than the correct date Jun 2018 which could cause difficulty.

@CB & FM Hey! I never did go to get the passport stamp. I still don't have my renewed (10 year) green card and am just waiting for that. I don't have any physical card as of yet as USCIS has it. 

 

I decided not to go to get the stamp as A) I HATE the immigration centers B) I feel like my case is weird with all the incorrect card, denial of a correction and now a renewal. It sounds horrible to try and explain all of this to an officer. 

 

I'm just waiting it out and hoping I receive it by fall so I can fly back home and see my folks. Please let me know if you decide to get a passport stamp. My husband really wants me to but i'm unsure about it.

Hey Maddie,

 

Last year when this whole error thing happened, we had a planned trip to Canada. So we decided to get my husband an I-551 stamp to show he was still in status as LPR, as his cond. GC showed wrong expiration date of Jul 2017. Canada requires visa for Brazil which is his native country but not for US LPR. We had a difficult time getting an infopass appt. here in NYC as always the slots were fiiled. One day I happened to try to check shortly after midnight and found open slots...one left in NYC...but before I could secure it, it was taken. ONe other office which showed as near us still had slots so we secured one of those. When we arrived there it was a fast process, could not even fill the paperwork out completely before being called to speak to officer. We were told that normally we would be referred back to NYC as it is our local, the other office being out of our jurisdiction, but due to the need to have the stamp immediately for our upcoming travel, they processed us that time. We were in and out in under an half hour although it was an hour long drive there and back.

 

On our trip, although he had to present himself on the ship, it was a cruise, to the Canadian authorities which he would not have had to do had his GC been correct and not expired, it worked for travel with no problems. Coming back in to the US was no problem at all. They looked at the stamp and passed him right through.

 

I suggest you get it done when you can so you can travel with out too much trouble. I hope your local office is not a busy one. We will have to redo the stamp come this Oct when it expires. Then we will have to do it in NYC which could be a bit more slow as it is a busy office compared to the Long Island office where we did it last year. I will have to make sure that when we need the appt. I am ready right at midnight to be able to get an infopass at NYC.
