its been 1 year my fiance is in pakistan with me but we are engaged since may 2016 she is US citizen.. what should we do to apply , do she need to be in US to apply for me. can any one guide us for the best procedure.

She will have to reestablish domicile in the US.

 

You wife will be the initial sponsor but she will need a cosponsor since she is not in the US working. This can be any US citizen or Permanent Resident. It does not have to be a relative.

she is a us born and came here in pakistan to study since she couldnt study there bcz her guardians (parents) are in pakistan..  my question is does she have to be in us tp apply for me or she can apply from here in pakistan too !

She can apply for you from Pakistan now but later on she will have to prove that she will establish domicile in the US.

hello, i want to apply for the k1 visa .. my faince is in pakistan with me. she is a us born and we are engaged since 2016 may .. what would be the best procedure and what is actually meant by the condition in visa process that couples should have met personally for 2 years or known. we are engaged since since 2016 may but we didnt have any function but she is my first cousin and i have known her since 2011 the first time time i met her , i mean what proof we can provide  and by looking at our situation,  are we eligible for the meeting condition for k1 visa ?

Does your fiance currently live in Pakistan or the US? She will need to prove US domicile (that she has a home, property, job, ect) in the United States. If she lives in the USA, what state does she live in? She will need to live in a state where 1st cousin marriage is legal. 

 

The meeting requirement only means that you must have seen her in person at least 1 time within the past 2 years. Boarding passes, hotel recipients, and photos are all things that you can use to prove that you have met in person within the past 2 years.

Congratulations on your engagement.  If you are with your fiancée, that means you met the requirement of meeting up with her in person within two years of filing your K1 application.  Does your fiancée live in the United States or is she living in Pakistan?  If she is living in Pakistan, it might be better to get married there and file for a CR-1 visa.  I am saying this for two reasons.  First of all, you can start your lives out as married people and then be waiting for immigration instead of waiting for people to let you get married.  Secondly, you mentioned that she is your first cousin.  That is not very socially acceptable in the USA.  Personally, I have nothing against it because I know a lot of Muslim people who do it, but I don't know if it is allowed in every US state.  You would have to check into that before getting here and finding out you aren't allowed to marry your first cousin.  If your fiancée lives in the United States and has an income to support you and everything checks out, you are good.  She is with you now and that puts you in the two year timeframe.  File away!  Good luck!
