Hi all!!!! I am a bit nervous and uneasy! I submitted my K-1 Visa in October, got notice that it was accepted and sent to the California service center. Although I am worried because I originally sent in an album with pictures of me and my significant other but my album was returned, I’m assuming it was too big. Now my issue is that I provided the paperwork and letters signed by both of us with our intent to marry as well as a copy of my passport and the entry stamps of when I entered Guatemala over the past 2 years. But I’m bummed that our pictures couldn’t be included and I don’t know if that will be an issue, also the passport photos.... I don’t know if there will be issues with not having those.... I have not received an RFE. It is now January  and I haven’t received notice of anything other than my case was received and sent to the California service center..... does anyone have any advice :(  I also received the form I-797C, Notice of Action that’s says my petition was received and is in process. I am just confused, I’ve read so many K-1 visa statements and I am a bit freaked out 😢

There's nothing to worry about at the moment

 

you did not receive an rfe because they are not at October cases yet or maybe after your other evidence they won't even need it( I think they may ask for it though.

 

they are doing june july at the moment so when they start October, you may or may not get an rfe. Do not worry now. It is not something too irregular. If you get an rfe then just send your pictures or whatever they ask for at that moment.

 

for passport photos though, you will most likely get an rfe if you couldn't send them. This also happens a lot, so again do not worry yet.

Okay thanks so much. It is just a bit overwhelming because I want things to work out well 😢 do you know how could I find out when they will be looking over October cases? Or is it just a matter of waiting it out?

You can create a vj timeline on your profile. It will give you an estimate. I believe right now it is late April to May for October.

Hello Kathergarc & Naes,

 

Sorry to interrupt, my K1 Fiancee Visa also filled last Sept 2017 and I also received the Form I-797C, Notice of Action that my petition was received and in the process as well.

 

But still, a bit worried. But as per Naes and the lawyer that I have spoken with that the process now is going to be until 4 or til 6 or more than.

 

I hope that will have a response from UCCIS soon.

All I can say is; that's correct estimation at the moment. And I am also a September filer, expecting September to start around early to mid march and later. However it takes around 2 months or more for a months cases to wrap up. I wouldn't expect anything realistically before 6.5 months.

No one above who claims to have filed the "K-1 visa" has done so.  They've filed the I-129F petition, which, when approved, enables the beneficiary to apply for the K-1 visa.

 

During this process, precision in wording and understanding is important.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
