  I don't believe LE would consider the car stolen since he did actually sell it. The buyer is currently not complying with the law, but it is not theft. It is illegal for the new owner not to register it within a specific period of time and of course driving without registration is also illegal but it could take some time to get caught. I would contact LE and just describe what happened to see if there is anything they can do. Even if they just take the vehicle information, it may help catch the guy. They may also have more information on what to do about the tickets. 

 

   A final note though is the buyer does have a time limit to transfer the title. If it's still within that time frame the buyer hasn't actually done anything wrong (besides procrastinating). It was your cousins responsibility to cancel the registration and avoid this.  

 

 

 

  

Thanks for the feedback.  The real problem is that he did not take a picture or make a copy of the signed title, so he really does not have proof of sale.  I agree, reporting it stolen is not really appropriate since he did actually sell the car, but hopefully the fact that the plate has been canceled will be enough incentive for the new owner to actually get the car registered in whatever state they live (we are not sure they live in NYC, they may have simply been visiting).

The trouble is, unless the buyer is made aware the plates are cancelled, he may not be inclined to register the car anytime soon.  And even if he IS made aware, and isn't the law-abiding type, he may STILL drive around with outdated tags until he gets caught.  Fingers crossed that the buyer is a legit person and all is rectified soon.

If the buyer forgot to transfer the title or is trying to avoid sales tax or paying for registration, the legal aspects of those things won't affect Bill's cousin. The main issue would be if the buyer sells the car to someone else, and that person doesn't check the title, then they may eventually try to get in touch with Bill's cousin.

To be honest you guys probably know more about peer to peer sales.

   I have only done it once, but I did research everything to find out what could go wrong. Quite a lot of things can really. Legally it's all probably the same issues as trading in at a dealer, but private sale has the potential to be between 2 people who have no idea what they are doing, so more likely for something to go wrong. I learned a lot at the time, but it was probably ~12 years ago now. 

 

   I think I said it before, but nowadays, if I am going to spend hours figuring out how to do something, it's usually easier for me to just to go to work, put in some overtime, and pay someone who knows what they are doing. I used to value the DIY aspect of things a lot more, but now I prioritize the time I have to waste doing something over how much money it costs or saves. Probably an age thing.

Update, crisis averted, the new buyer finally contacted my cousin and they officially transferred the title at the Secretary of State.  I don’t think he will make that mistake again.
