Needing guidance towards getting a B2 in Brazil

Timeline

Hey all,

 

My fiance and I are already in the process of getting a K1. We've received NOA1 but we've got a bit before getting NOA2.

I've visited him once in Brazil already and we've decided that we'd like him to come to America for a bit to spend some time with myself and my family here.

We submitted the DS-160 and are just waiting for his appointment next month. He already has his passport.

I noticed some applicants from here/Brazil have been rejected from getting the B2 because they didn't have strong ties to home. He is fairly young (under 21) and attends a great University. He has worked before but only for a period of less than a year. He is perfectly fluent in both PT and English. I know that might not provide much in their eyes.

 

For the most part I would be supporting him during his stay. When I applied for my visa to go to Brazil I needed proof of sufficient funds. 

Would an offer letter / pay stub / bank statement work from my own job or would he need his own funds? We put on the application that I would be supporting him / paying for expenses during his stay. 

 

It would suck if it's denied but at least we've got K1 to look forward to if so.

Timeline

He has to apply on his own merits, so saying you will sponsor him won't make a difference. Can he provide a letter from his university showing he needs to be back for classes at a certain point? If he is not currently working, it may be hard to provide strong ties to Brazil especially with the K1 in process. In my opinion, it's worth trying because he might get approved. :) Does he own any property in Brazil or have bills in his name? That could help show he needs to be back to take care of those responsibilities. Good luck! Hope you get an approval!

I'll see if he is able to get a letter from his uni. :) 

Unfortunately the only bill in his name is the internet bill so there isn't much else he is responsible for as far as I know.

We'd rather him continue his education here. My city is great for the major he'd like to pursue - he's just there to stay occupied while he is still living there. Surprisingly his credits will go towards a degree here. Already checked with the applicable university.

Plus, if something should happen, he is already there and can continue it until he finishes it.

So anything about his Uni course is irrelevant.

That's the harsh bit of this situation, he really has no ties.

You have to put yourself in the position of the interviewing officer who, by law, already presumes that the applicant will abuse their visa.

 

No matter how many "ties" you can think of for him to bring up at the interview the immediate response would be "How does that tie you to Brazil when you're already planning to leave it behind within the next year?"

 

Family - already planning to leave them behind

Education - already planning to continue it in the US

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

It's the strange and unfortunate the way the US tourist system works (or doesn't work depending on your point of view)

 

It makes it quite difficult for a lot of foreigners to get a tourist visa, but once a "tourist" is in the US they make it very easy to abuse it.

Not freely...  Visa is required,  but obviously quite easy to get

I understand completely from their point of view. I can appreciate it at least. :) The K1 won’t take much longer at this point so that’s our mistake for being hasty.

I have a Visa already, I visited him late last year. :) valid for 10 years if I’m not mistaken. Much easier to get on my end!

I see you are from the UK. As someone who has needed visas for both, let me reassure you that a UK visa is way more difficult (in terms of an incredibly time consuming application and piles of supporting documents) and more expensive than a US one. Actually my experience is that the US is actually one of the easier ones to get, for those who have to get visas for many countries (I’ve done schengen too and one or two other places like Russia...) ...as long as you can convince the CO you’ll go back home afterwards.

 

agree that if one is planning to leave one’s home country anyway it’s hard to show ties. A schengen type system where you show your return ticket or ticket out might work better for a case like this, but the flip side - and I’ve seen it happen - is if you get refused the visa, you end up way out of pocket on the air ticket and sometimes on all the reserved accommodation you have been required to show in the application.
