Hi, 

I’ve just received a request for initial evidence on form I-485 and I think I might be dumb but I don’t understand what initial evidence they are asking for.  Any help would be great.

what you need to do

You must provide the following information 

 

you have submitted secondary evidence and/or a birth affidavit as proof of your birth record. However, the evidence you have submitted is insufficient. Examples of acceptable secondary evidence may include, but is not limited to, church or school records listing your parents’ names and your date of birth, hospital records of your birth, or other official records indicating a country and record of birth. 

 

In additionto a birth affidavit or secondary evidence, Title 8 code of federal regulations, section104.2(b)(2)(ii) states:

 

whre a record does not exist, the applicant or petitioner must submit an original written statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whether similar records for the time and place are available. It must contain the following 

1. A seal 

2. A legible stamp

3. A signature with the title containing the words: secretary, registrar or birth and deaths information regarding the availability of birth records from an applicants country of birth may be found in the U.S. Department of state’s foreign affairs manual. An indication in the foreign manual that birth certificates are generally unavailable will be considered acceptable evidence the applicant’a birth certificate is not available. “ “

 

I’ve sent all information asked for in the insturcations section of form I-485.  So I don’t really underands what’s needed

What did you submit as proof of your birth record? That seems to be one of the areas that may be problematic.

Describe better what you sent as your birth certificate, because it was not accepted. Did it have your parents' names on it? 

I sent a copy of my full birth certificate with my parents names on.  Maybe with the American standard size paper it could have missed the bottom of the certificate off maybe I don’t know

You can't be serious! You did not look at the copy to make sure it resembles the original? Seriously!?

 

Before you send your package, you should examine everything, the copies you made, read instructions again and again... and then looked at your documents one by one AGAIN and AGAIN... slept over it, and examined everything again a couple times, over a couple days!

 

It is a long journey, you can't afford to be careless. 

 

For now, since you don't even know the condition of the birth certificate that you sent, best thing folks can tell you is to make another copy and send it.

Mine was a very long piece of paper so I used legal size (8.5x14) to copy then I folded it up three inches at one end to fit the rest of the pages. I may have had to reduce it slightly as well.

A photocopy of a certified copy suffices. If you go to interview you take the certified copy with you to show.

Okay I am going to be the one to point out, people come here for answers and help, there is no need and I repeat no need to belittle someone and downgrade them on a mistake, mistakes get made. no body is perfect.
