Brief history -

 

Immigrated August 2013

Separated from spouse Sep 2014

Divorced December 2014

Filed I751 Jan 2015

Met and married someone else Feb 2015

Received removal of conditions Oct 2015 without interview.

 

Now I am eligible to apply for citizenship later this year, and I am mulling over the question. I do have a single speeding ticket, but that is not the issue and there are no other issues beyond what I am outlining here.

 

I have heard that sometimes with citizenship it is better to let sleeping dogs lie, and I cannot help but think that a review of my immigration history might make them wonder why I got married a month after filing my I-751 (it was a spur of the moment thing, but 3 years later we are very happy)

 

Obviously the last thing I want is to rock the boat and end up in a bad situation, but at the same time the issues with immigration at the moment are making me thing that I would be wise to go ahead and do it when I am within the 90 day window.

 

Does anyone have an opinion or have seen anything similar?

When u filed to ROC did you let them know you were divorced?  From reading experiences on immigration forums is that, for citizenship you are interviewed again and proof of cohabitation is asked for and if your ROC was approved based on first marriage you may have a problem.  Like I said, this is what I have read and may not be written in stone.

I filed the ROC based on the divorce from the first wife, yes. I had only been in the US for 18 months at that point. They already have all the paperwork regarding the divorce including the final decree. I was surprised to be approved without an interview being as it was a waiver case.

 

I would be filing this time based on 5 years as a PR, NOT based on my current marriage with is 3 years old.

I think if you meet the requirements then you should apply. You went through the steps and were approved at each one. You got the 10 year greencard based on somebody believing you entered your marriage in good faith. You never broke any immigration rules, right? This is the government with a list of qualifications to check off. It's not Dr. Phil analyzing your mind for motives.

No, I have never broke any immigration rules. It was a bonafide marriage that just didn't work out - which happens. Aside from the marriage issue (which might just be in my head more than anything real) I have nothing in my history which would disqualify me in any way.

So no one sees an issue, even though I was married again before the I751 was approved?

 

Obviously the I751 was filed in the correct category, as a waiver rather than a joint petition - and it was approved without issue.
