One ruled a US citizen, the other not: gay couple's twins face unusual battle

Yeah, that's why said interesting case. It reminds me of a lesbian couple, one gave birth to the kids and then she got terminally ill and died. The other one couldn't raise the children, because legally she wasn't their mother. That could have been prevented if the law had allowed the other mother the same rights. She wasn't on the birth certificate so didn't had any right at all.

 

I think that's why they put both parents on the certificate?  But it doesn't provide a solution for the fact that one of them isn't biologically connected.

 

I wonder if it had made a difference if the non biological father had adopted the kid.

The lesbian example , is said for the lesbians.  That is why gays need equal partnership rights. However I would think it's important to record both biological parents.

How would this have differed if they had not been gay? If say the Husband had a surrogate baby in Canada and was the Israeli?

I don't think being gay has nothing to do with it. Its interesting because they kids are twins, although with different DNA and born in Canada.

If this was a straight couple who used a donor they probably would  have run into the same problems.

 

The statement about  " how are we gonna tell our baby later, that his brother can and he can't be president of the US" was funny though.

Both guardians sure, maybe one gave sperm. I support gay rights but that is nuts 

I was adopted, my biological parents are not on the birth certificate... so?

  Current immigration law is that in order for the child to be a USC at birth, one biological parent must be a USC, or the surrogate mother who carries the baby to term must be a USC. Straight couples could definitely run into this issue, but I would imagine it affects same sex couples disproportionately.

I could be wrong, but I thought that you not only had to be a citizen, but also born on US soil to be the President?  If they were born in Canada, surely that means neither can be president.

I can see where same sex couples run into certain legal problems whereas straight couples don't.

Good point, I looked it up. Apparently that's a misunderstanding.

 

"The presidential birth requirements set forth in the U.S. Constitution require anyone elected to serve in the highest office in the land to be a "natural born citizen." Many people misinterpret that specific presidential birth requirement to mean that candidates must be born on U.S. soil. Even though that is not the case, voters have never elected a president who was not born in one of the 50 U.S. states."

Untrue. John McCain was born overseas to American parents and was qualified to be  president.

 

 to be "a Natural Born Citizen" refers to your parents as well as where you were born.

Technically I believe McCain was born on US Territory (Panama Canal Zone), but you are right, there is no provision for being born on US Soil.
