Timeline

I am filling out I 130 for my spouse.

confused with Part 5 question

Have you ever previously filled a petition for this beneficiary or any other Alien?

for my spouse I am filing for the 1st time. but I filled for both of my parents in 2012 and they are already here in the US with the Green card. I don't remember the exact date of filling for my parents.

 

I filled for my sister and its still pending.

 

please help me with this part 5

The answer is yes. You've filed for three people - your mom, your dad, and your sister. You will need to provide details about each of their application in Part 5.

You didn't save any paperwork from when you filed for your parents? If you sent a personal check to USCIS when filing the I-130 application, you can try and go to your bank and ask for a copy of that check OR see if they kept track of when the check was cashed. That should provide you with a date close to your filing date.

You didn't save any paperwork from when you filed for your parents? If you sent a personal check to USCIS when filing the I-130 application, you can try and go to your bank and ask for a copy of that check OR see if they kept track of when the check was cashed. That should provide you with a date close to your filing date.

Do the best you can on dates but you provide details only of the previous filings.  You don't have a PREVIOUS filing for you spouse, just your parents.  Or you've FILED (past tense) for two people.

Father, mother and sister.

Father and mother already in US with Green card.

Sister case approved with USCIS but her visa is not available till this date.

 

so father and mother case status is approved

how about my sister filing status: approved, withdrawn, denied

Sister's case is petition approved, visa not available.  You can explain all this in the extra space at the end of the I-130.

my current wife don't have any children and this is her 1st marriage.

I was married before and got 2 kids.

 

so on part 4  item 25 I will list my self only as beneficiary's spouse is this correct

is this enough for I 130 package:

 

 

  1. A check for the amount of $535.00 to cover the filing fee;

  2. Form I-130 Petition for Alien Relative;

  3. Form I-130A, Supplemental Information for Spouse Beneficiary, for the beneficiary;

  4. Two (2) photos of the petitioner and two (2) photos of the beneficiary;

  5. Petitioner’s U.S. Passport biographical page;

  6. Divorce decrees of petitioner;

  7. Marriage certificate of petitioner and beneficiary;

  8.  Evidence of bona fide marriage.

Correct.  Your beneficiary has a spouse, you, and no children.  Enter the word NONE as the family name for the "person" after yourself.
